South Bend, IN — Right Of Way Occupancy Bond

South Bend's Occupancy security can concern using public space without excavation—for example, a commercial dumpster. Identify the company, activity and duration with Engineering Permits; a resident's dumpster order, contractor bond and Long-Term Occupancy approval are different steps.

What this bond does

Security matched to the actual South Bend public ROW occupancy request, not automatic excavation, building or long-term authorization.

Who needs it
The City-required occupying company/contractor-principal. For ROW dumpsters, current City guidance directs residents to a bonded company rather than a resident permit application.
Who it protects
The actual accepted instrument defines occupancy liability. The posted Long-Term application requires security protecting the City against losses from permitted acts/omissions; it does not establish unlimited coverage for unrelated private work.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Identify the occupying company and public space

The current City 311 dumpster guidance requires an Occupancy Permit for commercial dumpsters in streets, parking lanes, alleys or tree lawns and prohibits dumpsters on sidewalks. A bonded dumpster company normally applies; a contractor bonded with Public Works may obtain the permit under its own name for a non-bonded supplier's dumpster.

Residents cannot apply directly for that dumpster permit. Companies seeking bonding should request the actual Occupancy Bond form from Engineering Permits. For other equipment, deliveries or construction occupation, identify the actual space/activity and ask which City instrument and permission apply rather than assuming dumpster rules answer every occupancy question.

Ask about Long-Term Occupancy and the assigned amount

The City's dumpster guidance says occupation beyond 90 days requires Long-Term Occupancy, additional insurance and Board of Public Works approval, which may take weeks. The posted Long-Term application asks for location, nature/extent and duration, limits its occupancy to streets immediately in front of the construction site, and conditions permission on an executed/filed bond in a Board-approved amount.

Purchase Now opens Propeller; the option displays no fixed amount or term. Have Engineering and the issuer identify whether the requested Occupancy form, long-term security or another instrument is supplied, with correct principal/City recipient, sum and dates. Do not assume a building-registration amount or that one purchase covers every duration.

Arrange authorized execution and actual accepted filing, then obtain the separate electronic work permission and any required Board approval. Follow the actual location, traffic, removal/restoration and release or continuation instructions; payment is not approval to place equipment.

Sources

Have these ready

  1. Actual company/contractor, public-space location, activity and duration; resident versus applicant role.
  2. Engineering's Occupancy Bond form and determination of ordinary versus Long-Term request.
  3. Actual Board-assigned sum where applicable, legal parties/dates, insurance and issuer instrument match.
  4. Executed/accepted filing, actual occupancy/Board permission and traffic/removal/restoration/release conditions.

Questions about this bond

Can a resident apply directly for a ROW dumpster permit?

Current City guidance says to use a bonded dumpster company that handles the application. It separately allows a bonded contractor to obtain the permit under its company name.

Does more than 90 days mean simply renewing a short permit?

The City's dumpster guidance requires Long-Term Occupancy with additional insurance and Board approval. Ask Engineering for the actual duration-specific process.

Is the Long-Term application a bond form with a fixed amount?

It conditions permission on executed/filed security in a Board-approved amount; it is not the issued bond. Request the actual instrument and match this offering before ordering.
