What this bond does

This bond protects persons who sustain damages due to a mechanical contractor's breach of contract or unlawful acts in the performance of construction services. It ensures the Principal fulfills contractual obligations regarding labor, materials, and professional services while operating under their license.

Who needs it
Mechanical contractors applying for or renewing a Group 2 license in South Carolina who choose to satisfy financial requirements via surety bond rather than submitting net worth documentation.
Who it protects
The State of South Carolina is the obligee. The bond provides financial recourse for any person or business damaged by a breach of a construction contract or unlawful acts committed by the Principal during the license term.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Understanding the Group 2 Requirement

Under South Carolina Code Section 40-11-262, a Group 2 Mechanical Contractor must provide a surety bond in the amount of $15,000. This bond acts as a financial guarantee that supports the contractor's licensing status when they do not provide a net worth or working capital statement.

The bond is continuous in nature, meaning it remains active as long as the contractor holds the license or until they transition to providing a financial statement. It operates on a twenty-four-month license term cycle, beginning November 1 and concluding October 31.

Obligations and Cancellation Terms

The Principal is bound to comply with all statutory and regulatory requirements, avoiding any breaches of contract or unlawful activities. The aggregate liability of the surety for all claims during any single license term is capped at the bond amount of $15,000.

If a surety company intends to cancel the bond, it must provide written notice to both the South Carolina Contractor’s Licensing Board and the Principal at least thirty days before the effective cancellation date. Liability for damages accrued prior to the expiration of this notice period remains the responsibility of the surety.

Filing Procedures and Documentation

To satisfy the Board's requirements, the applicant must file the bond with an attached Power of Attorney document verifying the authority of the signer. The bond must clearly identify the Principal and the surety company authorized to conduct business within the state.

Claims against the bond must be filed using the official form approved by the Board. The surety is obligated to notify the Board in writing within thirty days if any payment is made in good faith against the bond.
