Tennessee — Tobacco Manufacturer's Warehouse Bond

What this bond does

The bond supports the manufacturer's warehouse license and secures the related Tennessee tax obligation. The posted model calls for a $20,000 penal bond to the state for each warehouse, distinct from an affixing-agent or cigarette tax-credit bond.

Who needs it
Tobacco manufacturers arranging the separate warehouse license described in Revenue's model. Confirm the licensed entity and each storage location; a general warehouse or logistics business is not automatically in this manufacturer-specific class.
Who it protects
Principal and surety bind themselves jointly and severally to Tennessee. The warehouse condition requires proper payment of all taxes, penalty and interest connected with the described storage-for-distribution activity during the bond's effective period. It protects state revenue rather than insuring tobacco stock, a warehouse building or customers' stored property.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for a Tennessee manufacturer's warehouse

Use the Tobacco Manufacturer's Warehouse option in the current Tax Bond. Rule 1320-4-3-.01(3) requires the $20,000 security before licensing, and the model applies that sum to each warehouse. Identify all locations and obtain Revenue's direction for the accepted instruments; one warehouse bond does not automatically authorize every site.

The affixing-agent option in the same document has a different amount calculation and $2,000 minimum. The separate cigarette-and-tobacco tax-credit form serves another undertaking. Do not select either merely because all concern tobacco taxes, and do not confuse this warehouse bond with a non-participating manufacturer's escrow bond.

The warehouse model is continuous from the entered effective date through the period the principal is licensed under the Tobacco Tax Law, unless properly terminated or canceled. Match that date and the licensed warehouse to the application. An annual licensing step does not itself create an annual bond expiration.

The surety can give Revenue sixty days' written cancellation notice, but liability incurred or accrued before the notice period ends remains. The model also retains liability for unpaid activity-related tax, penalty and interest accruing during the effective period up to its penal amount. Do not apply the notice period as a deadline for paying the underlying tax.

The current form requires notarized principal and surety attorney-in-fact signatures. Attach the power of attorney when an attorney-in-fact executes for either party, complete the applicable legal fields and arrange Revenue's acceptance. Use the warehouse condition rather than another tax paragraph's statutory references.

Purchase Now opens Propeller's Tennessee tobacco-warehouse application in a new tab. Match the legal manufacturer, separate warehouse location, required sum and effective date, then complete Revenue's license and security-filing process. Provider payment does not license a warehouse, approve unstamped stock or authorize stamp credit.

Questions about this bond

Is the warehouse bond the $2,000 affixing-agent bond?

No. The warehouse class requires $20,000 before licensing, and its model applies that sum per warehouse. The affixing-agent option has a different calculation and minimum.

Does any tobacco storage business use this listing?

The posted warehouse condition describes a manufacturer's own tobacco products stored for distribution in a structure separate from manufacturing. Have Revenue confirm your actual role and license rather than treating this as general storage-business coverage.

Does it also arrange cigarette-stamp credit?

No automatic credit approval follows. Revenue lists a separate cigarette-and-tobacco tax-credit undertaking. Match each requirement to the actual form and approval requested.

Can I omit notarization if the surety supplies a seal?

The current Tax Bond has separate notarized acknowledgments for the principal and surety attorney-in-fact. It also requires the appropriate power of attorney. Follow those fields and Revenue's current acceptance directions.
