Trempealeau, WI — Street Excavation Bond

The Village of Trempealeau's excavation rules provide for restoration security in a Village Board-determined amount, with two-year work responsibility. An annual bond may cover the principal's excavation work beginning January 1; the separate street-privilege requirement is not the excavation bond amount.

What this bond does

Helps an excavation applicant distinguish the Village's project/annual restoration security and work permit.

Who needs it
Applicants excavating Village of Trempealeau streets, public ways, sidewalks or village easements.
Who it protects
The Village rules address safe filling, pavement restoration/maintenance, village indemnity, ordinance compliance and the cost of village-performed repairs. The accepted guarantee or bond defines the actual secured undertaking.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Identify Village work and the permit

Confirm Village rather than Town or County road authority. Section 440-6 requires the Village Administrator's permit for openings/excavations in listed public areas and village-owned easements, with a signed written application describing location, nature and method.

The ordinary permit is valid for 30 days, with discretionary renewal by written request when work continues. That construction authorization is not the restoration-security period.

Confirm the Board-set sum and coverage route

The person performing restoration is responsible for two years from completion and must file a written guarantee or surety bond in an amount determined by the Village Board. The section also permits an annual bond covering the principal's excavation work for one year beginning January 1, subject to the stated conditions and Board-set amount.

Ask which route and form are requested before using the existing Propeller option. Do not transfer the separate Section 440-9 street-privilege amount to excavation, or assume an annual execution period eliminates the two-year restoration undertaking.

File security and follow restoration acceptance

Confirm the legal principal, Village recipient, actual amount and dates with the provider, then file executed security and separate required insurance with the Village Administrator and obtain the work permit.

The rules provide written defect notices during the two-year responsibility period, requiring repair or indemnification as directed. Coordinate work/inspection and final restoration with the Village and confirm actual release; the calendar year, permit expiry and completion date are not interchangeable.
