Washington — Consumer Loan Company (NMLS) Bond

Washington consumer loan companies use an electronic surety bond in NMLS for covered lending, origination and servicing activities. The required amount depends on the activity and, where applicable, prior-year loan volume.

What this bond does

File the Consumer Loan Act security required by Washington DFI for the company's actual licensed activities, using the correct NMLS company record.

Who needs it
Washington consumer loan applicants and licensees arranging a new ESB, an annual volume adjustment or coverage for a change in licensed activity.
Who it protects
The bond runs to Washington for the State and people with a cause of action under the Consumer Loan Act. It secures compliance with that Act and its rules, and money owed under those provisions. Surety liability is limited in aggregate to the bond's penal sum.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details

With no prior-year volume, the application amount under WAC 208-620-320 is $30,000. Applicable origination or brokering volume can require $50,000, $100,000 or $150,000 instead; combined residential and nonresidential origination uses combined volume. The rule separately sets $30,000 for student education loan servicing only and third-party residential mortgage loan modification services only. Residential-mortgage servicing alone has different net-worth, elective bond and MLO-sponsorship considerations, so do not assume every servicing company follows the same rule.

DFI requires the ESB in NMLS and no longer accepts paper bonds. The surety must have an NMLS account, and the applicant grants it access for electronic issuance. New applicants must have the bond in NMLS before filing the license application. Origination or lending licensees review required coverage with the annual assessment and submit any amount-changing rider through NMLS by the assessment deadline. The statute makes the bond continuous, with cancellation effective forty-five days after the director receives notice.

Purchase Now opens Propeller's Washington consumer loan application in a new tab. Bring the DFI request, company NMLS identifier, exact legal name, business activities, relevant prior-year volume, existing ESB and required sum and dates. Check these before paying, then coordinate the surety's NMLS access, issuance and any required rider submission. Keep DFI acceptance and complete the separate company and branch licensing steps; purchase does not itself authorize lending.

Have these ready

  1. Describe residential and nonresidential origination, brokering, modification and servicing activities separately.
  2. Provide relevant prior-year closed-loan or brokered volume and the existing ESB.
  3. Confirm the DFI-required sum and the correct legal company and NMLS license.
  4. Arrange NMLS surety access, issuance or rider submission and separate licensing acceptance.

Questions about this bond

Is $30,000 always enough?

No. It is the application amount where there is no prior-year volume and applies to certain specified activities. Applicable origination or brokering volume can require a higher bond under the rule.

Can I mail a paper bond to DFI?

DFI says paper bonds are no longer accepted for this process. Coordinate electronic issuance through NMLS for the correct company license.

Does every residential mortgage servicer need this same bond?

No. WAC 208-620-320 distinguishes servicing-only companies, including elective security in lieu of net worth and MLO sponsorship. Have DFI match the requirement to your actual activity.

Does my surety's rider automatically complete the adjustment?

No. DFI says the rider is issued electronically but still requires submission to the regulator through NMLS. Retain the resulting acceptance.
