Consumer-lending compliance errors
Mistakes in truth-in-lending disclosures, fair-lending practices, or contract terms can trigger borrower and regulatory claims across the loan book.

Your loan remains part of the business when collection or repossession is handed to an outside firm. Lending-service liability needs to reflect those arrangements without treating borrower default or dealer fraud as automatically insured losses.
The Southern Agency can review your dealer, servicing and recovery arrangements alongside actual funds access, borrower records and requested policy terms.

You may originate loans or buy dealer contracts, then service accounts, collect payments or oversee vehicle recovery. Those roles create different borrower, data and funds responsibilities from the ordinary credit risk that a customer will not pay.
The Southern Agency can review what your company does itself and what it delegates to dealers, servicers or recovery firms. We can compare lending-service, crime and data terms with actual complaints, funds access and requested indemnities.
Mistakes in truth-in-lending disclosures, fair-lending practices, or contract terms can trigger borrower and regulatory claims across the loan book.
Recovery agents and collection activity can lead to wrongful-repossession, harassment, or breach-of-peace allegations from defaulted borrowers.
Loan files hold Social Security numbers, income records, and payment data, making a system compromise a significant breach and liability exposure.
Falsified income, dealer deception and employee theft involve different people and loss methods. A funded loan remaining unpaid is not automatically a crime policy's covered direct loss, even when the application was false.
Owners, investors, or creditors may challenge underwriting standards, portfolio performance, or capital decisions.
Underwriting, servicing, and collections staff create potential for discrimination, harassment, and wrongful-termination claims.
Policies to ask about. Which ones fit depends on your operations, your contracts, and the carrier’s forms.
These hypothetical examples are not agency claim results. Whether a loss is covered depends on the facts, policy terms, and applicable exclusions.
A borrower says payments were brought current before an outside agent recovered the vehicle and seeks damages from the lender. Lending-service terms may help with a covered wrongful-recovery claim only if the service, insured entity, contractor role and alleged harm fit. Examine payment reconciliation, instructions and contract records alongside collection or bodily-injury/property exclusions; an indemnity to the agent is not itself insurance.
An intrusion exposes application and income records held by the lender or a servicing provider. Cyber may fund included forensic, response and privacy expenses if the data, system and provider event fit. Establish actual notification duties and insurer notice or consent; the incident does not itself establish every response cost, loan correction or borrower remedy.
Dealer-submitted income documents are false, and the lender is left with funded contracts borrowers do not repay. That is not automatically insured employee theft, forgery or direct computer fraud. Compare the actual participant, property, loan or fraud agreement, loss method and discovery, notice and proof terms; a crime heading does not guarantee recovery of principal.

Assess lending-service claims, borrower data, funds theft, management and employment allegations and office property against the actual roles and requested terms. Loan balances, repossessed collateral and work-injury obligations need separate review; the listed policy names do not establish repayment or a complete package for every lender.
Describe who orders and performs recovery, handles payment updates and controls the vehicle. Compare wrongful-repossession and collection terms with the actual parties, alleged harm and bodily-injury or property exclusions. Ordinary GL, lending E&O or an indemnity to an outside agent does not establish every recovery claim.
Loan files hold Social Security numbers and income data. Cyber coverage may help with breach response and liability if systems are compromised, depending on the policy.
Crime may help with specified theft or fraud, not ordinary credit default. Establish who acted, which money or property was lost, whether any loan or forgery provision applies and the discovery, proof and notice conditions. Dealer deception, false income or an unpaid contract alone does not prove an insured loss.
A capital or warehouse-funding agreement may request particular policies, limits or endorsements. Bring the actual wording and compare it with insurer acceptance and issued terms before committing. A certificate or preliminary discussion does not establish that the lender's request has been satisfied.
Yes. Loan volume, borrower mix, and loss history are common rating factors. Coverage availability and pricing depend on underwriting.
Bring your questions, current policies, and relevant contracts. An agent can review coverage terms, exclusions, and the information carriers ask for, then explain the options available to you.
