Albany, NY — Street Opening Bond

Albany's Department of General Services reviews street and sidewalk openings, restoration plans, and any required security. Obtain DGS's assessed amount and accepted instrument before using this Street Opening Bond offering; the published application packet does not establish that every opening uses the same commercial surety form.

What this bond does

Match this offered bond to the City of Albany's actual pavement-opening security request. The packet describes application-dependent, percentage-based security, but the exact surety form and substitution conditions for this offering remain unconfirmed.

Who needs it
Applicants and contractors proposing disturbance within a City public right-of-way, including utility, driveway, curb or sidewalk work. The application identifies applicant and contractor separately and records who will perform restoration.
Who it protects
The City's concern is proper restoration and correction of dangerous or deficient work. The accepted instrument determines its terms; the listing does not promise completion of an unrelated private project or release when a permit expires.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Prepare a complete opening and restoration sketch

The August 2023 packet requests the location, purpose, opening dimensions, dates, applicant and contractor details, and restoration responsibilities. Its sketch checklist includes nearby streets, utilities, fixtures, and restoration details; incomplete information can cause rejection.

DGS separately requires insurance evidence. Ask the Department to assess the proposed opening and specify whether it will accept this offered surety, the form wording, amount, principal and effective dates. Do not turn the packet's conditional security language into a fixed bond for every job.

Larger openings have additional review steps

For openings greater than fifty feet, the packet describes scaled plans, an approved traffic-protection plan, a construction schedule, preconstruction coordination and final-inspection notice. Confirm which requirements apply to the actual project.

Those additional provisions include a permanent-restoration guarantee measured from City acceptance and continuing responsibility for noncompliant work. Do not infer a bond term or release date from the ordinary permit-completion window.

Confirm the security, then complete both applications

Once DGS confirms the surety matches its request, continue through the existing Propeller application. Check and file the executed document using DGS's instructions; provider application and City opening-permit application are separate.

The permit application must be approved and issued before ordinary work starts. Street moratoria, inspections, restoration and any necessary new permit or written work conditions still apply; receiving a bond does not waive them.

Questions about this bond

Does every Albany opening use the same bond amount?

That is not established by the packet. DGS must assess the application and confirm the required security and whether it accepts the offered commercial surety.

Does a large opening require more than the ordinary sketch?

The packet has additional provisions for openings greater than fifty feet, including plans, traffic protection, scheduling and inspection coordination. Obtain the project's requirements from DGS.

Does finishing within the permit period end the restoration obligation?

No automatic release is established. The packet separately describes inspection, acceptance and continuing restoration duties. Confirm the actual surety and release conditions with DGS.
