Fishkill, NY — Single Job Right Of Way Bond

Confirm whether your Fishkill single-job request comes from the Town or Village before ordering. Both publish road-opening procedures, but the Town form and Village packet state different security details. This listing's exact authority and accepted instrument still need confirmation.

What this bond does

Provide the accepted right-of-way security for one defined job and requesting authority. Do not apply the Village's published amount or deposit alternative automatically to a Town road opening.

Who needs it
An owner, contractor or utility arranging a specific Fishkill opening. Identify the actual road authority, legal applicant, work location and project scope rather than choosing from the locality name alone.
Who it protects
Both published processes address permitted road work and restoration, but the issued bond's accepted wording controls its security. Single-job security is not a blanket permission for future openings or a substitute for the work permit.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

The Town and Village requirements are separate

The Town's August 2020 road-opening form is issued by the Town Highway Superintendent under its stated code provision. It requires a surety bond for all road-opening permits but does not state a fixed amount on that form.

The Village's separately posted procedure, effective June 2003, lists a $10,000 bond and a possible $1,000 cash/certified-check alternative, with release after acceptable completion determined by the Village. Confirm the operative Village instructions; those figures are not verified Town requirements.

Describe the opening and restoration obligation

The Village procedure requests a map, exact address, purpose, excavation length/width/depth, contractor details and insurance. The Town form identifies the highway and authorized work and requires protection of travel, restoration and ongoing repair of affected installations.

Tell the requesting office that you are arranging the offered single-job bond. Obtain its accepted form, amount, principal, dates and any maintenance period, and confirm whether the proposed scope fits that instrument.

Purchase and permit approval are different stages

Once the correct authority and instrument are matched, use the existing Propeller application. Deliver the executed document with the authority's required work and insurance material.

Obtain that authority's approved road-opening permit before work. Do not treat a Village deposit alternative as Town surety acceptance, or satisfactory completion at one office as automatic release by the other.

Sources

Have these ready

  1. Confirm Town versus Village and actual road jurisdiction.
  2. Identify the one job, applicant, highway location, excavation scope and restoration plan.
  3. Obtain the currently accepted form, amount, dates and any security alternative from that authority.
  4. Arrange provider application, executed filing, separate permit approval and completion/release steps.

Questions about this bond

Can I assume the Town requires the Village's $10,000 bond?

No. The Town form requires surety security but does not state that amount. Obtain the Town's actual assessment and accepted form.

Can a $1,000 deposit always replace the surety?

No universal alternative is established. The older Village procedure describes that possible alternative; confirm current Village acceptance and do not apply it to a Town request.

Does single job include later openings?

Do not assume so. Confirm the named job and accepted scope with the requesting authority, and obtain separate work authorization for any additional activity.
