Arkansas — Medical Marijuana Cultivation Facility Bond

Use the Arkansas Medical Marijuana Commission's cultivation-facility performance undertaking for this option. Its published model sets a $500,000 maximum penal sum for an approved cultivation facility. Prepare the actual approval, license period and facility record; the separately posted dispensary bond is a different undertaking.

What this bond does

Back the cultivation facility's defined Arkansas-law and license obligations, including covered revocation damages and compliance requirements when approval is not renewed.

Who needs it
MMC-approved Arkansas medical-marijuana cultivation facilities arranging required performance security or continuation for their actual licensed operation.
Who it protects
The Medical Marijuana Commission is the obligee and sole claimant with legal standing under the published model. Covered revocation damages include replacement-facility costs, stopping and cleaning the site, product removal/destruction, unpaid ABC penalties and outstanding DFA-account taxes, penalties and interest. Patient or other cultivation-facility claims require the assignment described in the model; those parties do not acquire direct contractual rights against the surety.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for cultivation performance and claim timing

The Commission's current forms directory selects separate cultivation-facility and dispensary performance bonds. The complete cultivation model identifies a $500,000 maximum, the approved facility and a one-year license effective period. It covers the stated revocation and compliance damages, including applicable nonrenewal duties. Match that actual approval rather than using a dispensary sum or assuming the bond protects the grower's crop.

The claims-made coverage period ordinarily continues thirty days after the license effective period expires. If the license is revoked, the stated coverage ends one year after revocation. The model separately requires the Commission's certified-mail statement, detailed damages and supporting records within thirty days of the event giving rise to a claim; failure to comply waives recovery of the untimely damages. Its court-action limit is one year after the coverage period expires. The longer period does not replace the shorter event-documentation deadline.

Before ABC initiates a revocation action, the model permits surety cancellation on ninety days' written notice to both the principal and Commission. It excludes the stated losses from surety cancellation, nonrenewal or inability to replace the bond. Additional one-year terms are evidenced by continuation certificates issued to the Commission. Coordinate the actual license and coverage dates instead of assuming renewal automatically creates a fresh limit or a new approval.

The model requires principal and surety execution and corporate seals. Keep the approved legal facility name, location, Commission record and any continuation certificate together for filing. A completed provider application cannot substitute for MMC approval or the facility's continuing operating duties.

Questions about this bond

Is the dispensary performance form interchangeable?

No. The Commission separately posts the two forms. Its cultivation model uses a $500,000 maximum and cultivation-facility approval and obligations. Match the facility's actual request instead of carrying over the dispensary amount.

Is every claim deadline one year?

No. The model distinguishes the license and coverage periods, a thirty-day event-documentation requirement, and a one-year court-action limit measured from coverage expiration. Review all of them with the actual approved dates.
