Arkansas — Medical Marijuana Dispensary Bond

Arkansas's published medical-marijuana dispensary performance bond sets a $100,000 maximum penal sum and names the Medical Marijuana Commission as obligee. Match the approved dispensary, license period and accepted coverage dates before applying. The Commission posts a separate cultivation-facility form; use the dispensary undertaking for this option.

What this bond does

Secure the defined damages associated with dispensary-license revocation or failure to comply with the applicable Arkansas requirements, including the form's nonrenewal obligations.

Who needs it
Approved Arkansas medical-marijuana dispensaries responding to the Commission's performance-security requirement, including those coordinating license renewal and continuation documents.
Who it protects
The Medical Marijuana Commission is the form's only claimant with legal standing. Defined covered damages include specified replacement and closure costs after revocation, unpaid ABC penalties, associated DFA-account taxes, penalties and interest, and other stated compliance failures. Patients or other dispensaries do not receive direct contractual claim rights; the Commission may assert assigned claims as the form provides.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for Commission claims and coverage periods

The Commission's current forms page separately lists dispensary and cultivation performance bonds. The dispensary model uses $100,000 and describes the approved license and Arkansas-law obligations. Its revocation-related damages include replacement-dispensary costs, closing and cleaning the site, remaining-product destruction, unpaid ABC penalties and outstanding DFA-account tax liabilities. Read these defined damages rather than assuming general patient-loss or property coverage.

The form distinguishes the one-year license effective period from a claims-made coverage period. Coverage ordinarily ends thirty days after that effective period expires, but ends one year after revocation if the license is revoked. Use the actual approved dates; a calendar-year assumption could produce the wrong claim period.

The model also requires a documented, itemized claim by certified mail within thirty days of the event and states a separate one-year court-action limit measured from coverage-period expiration. Those are different deadlines, and the form treats late event documentation as a waiver. Confirm the actual accepted terms without treating the longer period as an extension of the shorter one.

Surety cancellation is available on ninety days' written notice to the principal and Commission before ABC initiates revocation action. The form excludes the stated damages from surety cancellation, nonrenewal or inability to replace the bond. It permits additional one-year terms evidenced by continuation certificates. Coordinate the actual license, bond and continuation documents with the Commission.

Questions about this bond

Can patients claim directly against this form?

The published model gives legal standing only to the Commission. It allows the Commission to assert patient or other dispensary claims after obtaining an assignment as described in the form; it does not create a direct surety contract with those parties.

Does the bond simply end when the annual license ends?

The model has a separate coverage period: ordinarily thirty days after the effective period, or one year after revocation when applicable. It also contains event-notice and court-action deadlines. Match the actual dates and accepted terms rather than assuming all periods end together.
