Brier, WA — Right Of Way Performance/Maintenance Bond

Brier's Performance/Maintenance Surety form requires both the permit or approval and the type of security to be described. Identify the ROW work and any maintenance conditions specifically; the city's multipurpose form does not make every project subject to the same amount or warranty period.

What this bond does

Secures the improvements, activities or work and documents identified in the Brier ROW permit/approval undertaking.

Who needs it
Owners, developers and contractors arranging Brier ROW performance or maintenance assurance.
Who it protects
The City of Brier is the obligee. The selected permit, project documents and bond-type description define the undertaking, rather than unrelated tree, subdivision or stormwater duties elsewhere in the multipurpose form.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Complete both the project and bond-type descriptions

The city form separately requests the permit/approval type and numbers, owner/developer/contractor, address/parcel, and type of bond. Specify ROW work and any actual maintenance requirement rather than leaving those fields generic.

The street-opening packet's city-use block offers a $3,000 or other required bond/assignment amount. That is not proof of a universal $3,000 figure. Obtain the city's actual sum, covered work and any maintenance or monitoring conditions.

Arrange execution and city acceptance

Use the existing Propeller Purchase Now option after confirming the city's selected undertaking and amount. The surety form requires both principal and surety signatures, notarized surety signature and attached power of attorney.

The form takes effect on city acceptance, not simply provider issuance. It permits additional security when circumstances change and assigns the city the determination of satisfactory performance. Obtain its actual completion and release directions; no fixed maintenance period is supplied by the form alone.

Obtain the permit and arrange inspections before covering work

The street-opening packet asks for work limits, trench/boring/cut areas, schedule, easements, restoration method and traffic plan. It requires prior approval for cutting improved streets/sidewalks, and inspections before covering work or concrete/asphalt placement.

The surety form requires at least 24 hours' notice to the city construction inspector before starting; the permit packet separately requires inspection requests at least 24 hours ahead. Obtain separate work approval and retain the city's performance and any maintenance acceptance records.

Questions about this bond

Does the form impose every listed type of security?

No. It is a multipurpose form with separate fields for the actual permit/approval and bond type. Identify the ROW work and any required maintenance conditions.

Is the bond effective as soon as the provider issues it?

The city form says it takes effect on acceptance by Brier. Complete execution and obtain city acceptance separately.

Is $3,000 or a particular maintenance period automatic?

No. The permit packet allows $3,000 or another required sum, and the surety form does not set one fixed maintenance period. Obtain the city's actual instructions.
