California — Cemetery Brokers Bond

Applying as an individual California cemetery broker? The Cemetery and Funeral Bureau requires a $10,000 surety bond for that license, but not before sitting the broker examination. Check the applicant's role first: the Bureau lists different documents for corporate, association and partnership broker applications.

What this bond does

Supply the Bureau's accepted $10,000 Surety Bond of Cemetery Brokers for the applicable individual broker license.

Who needs it
The individual cemetery broker named as licensee on the undertaking. The selected form describes an applicant without a cemetery certificate of authority; confirm the license category rather than substituting cemetery-operator or salesperson security.
Who it protects
The actual form runs to the People of California and secures honest, faithful performance and handling of received sums by the broker, salespeople and employees. It covers the specified cemetery laws, agency obligations and connected fraud, with an action available to a person sustaining an injury covered by the bond.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for the individual broker and filing stage

The Bureau separates eligibility, examination and issuance of the license. Its instructions place the individual broker's $10,000 bond among requirements for licensure that are not prerequisites to sitting the examination. Buying the bond does not satisfy the experience, residency, background or examination requirements.

A cemetery broker handles activities such as sales, purchases, listings, leases or negotiations involving cemetery property or interment services. A cemetery salesperson works under a licensed broker. For corporate or association/partnership applications, the Bureau instead identifies authorization records; confirm the actual applicant category before ordering an individual broker undertaking.

The selected form extends to the principal's salespeople and employees and requires honest application of sums received. Its condition includes Chapter 12 of Division 3 of the Business and Professions Code, the cemetery provisions of Division 8 of the Health and Safety Code, agency obligations and connected fraud. It is not an endowment-care fund or a preneed seller's trust deposit.

The surety's aggregate liability is $10,000. The form continues until Bureau release or surety termination under its notice provision, rather than resetting the limit with the annual license renewal. Surety cancellation requires delivery of 30 days' written notice to the Bureau and does not affect liability incurred or accrued before that period ends.

Match the licensee name, bond number, effective date and principal and surety execution before Bureau filing. The form also requires the principal and surety respectively to notify the Bureau immediately when the covered notice of an action against the principal, salespeople, employees or surety is served. Keep the complete undertaking available after issuance.

Questions about this bond

Must I buy the bond before sitting the broker examination?

The Bureau lists the individual broker's bond as a requirement for licensure, but not before sitting the examination. Match the filing stage and actual applicant category with the Bureau.

Is $10,000 available separately for every salesperson or renewal?

No. The selected form includes salespeople and employees within its condition but limits the surety's aggregate liability to $10,000. Its continuation and the annual license cycle do not create a separate limit for each person or renewal.
