Colorado — Preneed Contract Seller Bond

Colorado's published preneed application instructions offer a $100,000 bond as an alternative to the specified financial statements demonstrating $100,000 net worth. Identify which route the Division of Insurance accepts for your seller before applying. Buying this bond does not replace the preneed contract, trust or licensing documents.

What this bond does

Provide the Division's accepted bond for the preneed seller's financial-qualification route and the obligations stated in its Bond of Preneed Contract Seller.

Who needs it
The individual or entity seeking or maintaining Colorado authority to sell contracts for future funeral, entombment or cremation goods or services, using the accepted bond route.
Who it protects
The actual $100,000 form runs to Colorado and requires performance of the governing Act's agreements and conditions, including its broad indemnity to the State for covered claims and expenses from granting the license. Persons covered by a preneed contract, their beneficiaries, heirs or estates may proceed against it upon the principal's default.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for the financial route and seller documents

The Division's published instructions distinguish the specified accountant-signed balance sheet, income statement and cash-flow schedule showing at least $100,000 net worth from the alternative $100,000 bond. Confirm the route and current submission instructions with Corporate Affairs; do not assume every licensed funeral establishment must purchase this bond.

Match the seller's legal name and any accepted trade-name filing to the Secretary of State records. The application packet also calls for contract forms, the negotiated trust agreement, provider agreements and a plan of operations. Insurance-funded arrangements require the applicable specimen policy and assignment form; neither a policy nor a funeral-establishment registration replaces the seller's own authority.

The actual bond continues while the applied-for license or its renewals remain in force, subject to its terms. Its $100,000 aggregate does not replenish with each renewal or each contract. The published June 30 license expiration and annual renewal do not, by themselves, make this a one-year bond.

Surety cancellation requires 30 days' written notice to the Commissioner with a copy to the principal. The form relieves the surety for breaches occurring after cancellation takes effect, not breaches that already occurred. Prepare the principal and surety execution and coordinate the completed bond with the Division's license submission.

Questions about this bond

Does every preneed seller have to use the bond route?

The published application instructions describe the $100,000 bond as an alternative to specified financial statements showing the required net worth. Confirm which route Corporate Affairs accepts for the particular seller and application.

Does annual license renewal create another $100,000 limit?

No. The actual form states an aggregate limit regardless of the number of claims or length of the license and its renewals. Match its continuation and notice terms rather than treating each renewal as fresh security.
