Illinois — Funeral Or Burial Funds Act Bond

A seller's Illinois Funeral or Burial Funds Act license is separate from its professional funeral credentials. The Comptroller's current annual-report instructions require each licensee to maintain at least $1,000 in bond or accepted letter-of-credit security. Bring the actual license and directed sum: the Act also permits higher and, after qualifying violations, additional security.

What this bond does

Maintain the Comptroller-required fidelity security associated with the seller's license under the Illinois Funeral or Burial Funds Act, 225 ILCS 45.

Who needs it
The licensed seller of preneed funeral or burial contracts, whether the permitted funding uses trust deposits, life insurance or annuities. An individual selling on behalf of a licensee is not automatically a separate licensed principal.
Who it protects
Section 3 requires fidelity security approved by the State Comptroller. It expressly directs qualifying additional security to the Comptroller for the use and benefit of trust-fund beneficiaries. Match the accepted fidelity condition to the seller's handling of preneed funds; do not treat it as a replacement for the required trust deposits or an insurance policy.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for the seller's fidelity security

The current report's bond/letter-of-credit instructions state a minimum of $1,000 and require the security to run to or indemnify the Comptroller. Section 3 allows the Comptroller to require application security up to $10,000. Obtain the actual required sum rather than selecting a universal amount from the catalog name.

Additional security is a separate matter. After notice and an opportunity to be heard, a finding that the licensee violated the Act within the preceding five calendar years permits additional security equal to one-tenth of the trust funds. The base figure is not a cap on that additional requirement. Do not import the separate Cemetery Care Act's worksheet or $15,000 exclusion.

Use the licensed seller's exact name, license number, principal office and branch information. Section 3a-5 makes the licensee responsible for its representatives and requires their statutory affidavits, while not requiring individual licenses for those selling on its behalf. A separate business selling on its own account needs its own authority.

Trust funding remains a separate duty. The Act requires the specified deposits within 30 days of receipt, an authorized corporate fiduciary and filed trust agreements. Life-insurance or annuity funding instead has its own permitted structure and insurance-licensing requirements; it does not turn a policy into this fidelity undertaking.

The current annual report records the bond or credit number, amount and actual expiration date alongside the trustee and funding information. Coordinate the full Comptroller-accepted condition, execution, effective dates and continuation or replacement. The seller's five-year license renewal cycle does not establish the period of its bond.

Questions about this bond

Is $1,000 always the full requirement?

No. It is the minimum in the current annual-report instructions. Section 3 permits the Comptroller to direct base security up to $10,000 and, after the specified violation finding and process, separate additional security. Confirm the actual direction for the licensee.

Can the bond replace the preneed trust deposits?

No. The Act separately prescribes trust deposits, authorized trustees and agreements, or qualifying life-insurance or annuity funding. Match the seller's funding arrangement as well as its fidelity security.
