California — Certificate Of Title Bond (Mobile Home)

A missing mobilehome title and missing proof of ownership are different problems. HCD lists a duplicate-title process for an existing owner and a bond process for ownership evidence that cannot be obtained. Have the Department identify the right route before opening this mobilehome title-bond application.

What this bond does

Support an HCD-approved mobilehome title application using accepted security when regular ownership evidence is unobtainable.

Who needs it
The person arranging HCD-required security for the specifically identified manufactured home or mobilehome. Match the accepted principal to the application; HCD's instructions permit the purchaser of the bond to be the owner or another person.
Who it protects
The HCD sample covers the Department, its officers and employees, later purchasers, persons acquiring liens or encumbrances, and successors in interest against covered ownership defects and undisclosed claims or liens. An interested person may sue for a covered breach, with the stated aggregate surety limit. The document does not insure the home's physical condition or clear disputed ownership.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for missing ownership evidence

For an ordinary lost document, HCD's current forms page identifies RT 480.4, Application for Duplicate Certificate of Title. If a legal owner is recorded, that legal owner supersedes the registered owner for requesting the replacement. Do not buy a bond merely because the paper title is missing.

For the bond route, RT 476.6I asks for the decal/license and serial numbers, trade name, acquisition history, last-owner contact efforts and the reason evidence is unavailable. It also asks for the current value and a signed certification under penalty of perjury. Explain the actual gap rather than substituting a bill of sale for every required release.

HCD's RT 480.0 instructions reserve the final decision on the need and sum to the Department. They compare the sale price, market value considering year, makeup, condition and location, and the average of the specified N.A.D.A. and Kelley guide values, using the greatest figure. This is not a direction to use a standard motor-vehicle percentage.

The required protection is for three years. RT 480.0 includes a sample for the surety's preparation, not a universal Department-issued bond form; its sample calls for signatures and dates and notarial acknowledgments of both principal and surety. Match the home description and full accepted undertaking to HCD's request.

Written-request return at the end of three years, or earlier if the home is no longer California-registered and the valid title is surrendered, does not release liability already incurred. Complete the ownership application and supporting documents as directed. The purchase confirmation is not the certificate of title.

Have these ready

  1. Confirm with HCD whether this is a duplicate-title request or unavailable-ownership-evidence case.
  2. Gather the home identifiers, acquisition records and attempts to obtain prior-owner documents.
  3. Complete the signed RT 476.6I facts and HCD-required valuation evidence.
  4. Match the accepted principal, sum, three-year protection and complete undertaking.
  5. Arrange both acknowledgments and submit the executed document with the required HCD title packet.

Questions about this bond

Do I need a bond just to replace a lost title?

Not automatically. HCD has a duplicate-title application, with the recorded legal owner taking priority where applicable. Ask HCD which process fits the record and the documents you can obtain.

Does the bond remove an undisclosed lien?

No. The sample protects the specified parties against covered losses from ownership defects and undisclosed claims, liens or encumbrances. That protection is not a lien release or a ruling that the applicant owns the home free of other interests.

What follows Purchase Now?

RLI's California mobilehome certificate-of-title application opens in a new tab. Match HCD's request, the home and accepted principal, required sum, full undertaking and actual dates, then complete execution and HCD filing. Payment alone does not issue a title or complete a transfer.
