California — Mobile Home, Comm. Coach, Truck Camper Or Floating Home - Certificate Of Title Bond

Start with the unit's HCD registration record and the ownership documents you cannot obtain. California's Housing and Community Development Department may accept a bond when regular ownership evidence is unavailable, but it decides whether security is needed and the required sum. Its current instructions cover manufactured homes/mobilehomes, commercial modulars, truck campers and floating homes.

What this bond does

Support an HCD certificate-of-title application when the Department accepts a bond in place of unavailable regular ownership evidence.

Who needs it
The applicant arranging security for the particular HCD-titled unit. HCD's instructions allow the principal purchasing the bond to be the owner or another person; confirm the accepted principal and unit classification with the Department.
Who it protects
HCD's sample protects the Department, its officers and employees, subsequent purchasers, persons acquiring liens or encumbrances, and successors in interest against covered ownership defects and undisclosed claims, liens or encumbrances. It is not insurance against damage to the unit or proof that the applicant has an unchallenged title.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for the unit class and value evidence

Match the actual unit to HCD's record, including its decal or license number, serial numbers and trade or manufacturer name. The current HCD instructions use the category commercial modular. Bring the record for a unit described as a commercial coach rather than relying on the catalog label to establish its current classification.

Prepare the Statement of Facts — Bond, HCD RT 476.6I. It asks how, when and from whom the unit was acquired, the efforts to contact the last owners of record, why ownership evidence is unavailable and the current value. Its signatures certify the facts under penalty of perjury; buying security does not replace that statement.

HCD's instructions compare three figures: the total sale price, current market value based on the unit's year, makeup, condition and location, and the average of the specified N.A.D.A. appraisal-guide and Kelley Blue Book values. They call for the greatest figure, with the final need and amount determined by HCD. Do not apply an ordinary motor-vehicle bond multiplier without the Department's direction.

HCD requires three-year protection and sufficient identifying detail, principal and surety signatures and dates. RT 480.0 supplies instructions and a sample to assist the surety, not a Department-issued form ready for every applicant. Its sample calls for notarial acknowledgments of both principal and surety.

The sample allows an interested person's action for a covered breach and limits aggregate surety liability to the stated sum. Written-request return at three years, or earlier when the unit is no longer California-registered and its valid title is surrendered, does not erase accrued liability. Coordinate the full accepted undertaking and title packet with HCD.

Questions about this bond

Can I choose the sum from the sale price alone?

HCD's instructions compare the sale price, specified current market value and specified guide-value average. They use the greatest figure and reserve the final amount decision to the Department. Obtain its direction for the actual unit.

Is RT 480.0 itself a ready-to-file issued bond?

No. HCD describes it as instructions with a sample to assist a surety in preparing the undertaking. The actual document must identify the unit and principal and satisfy the accepted terms, execution and acknowledgments.
