What this bond does

Business and Professions Code Section 6405 requires registration security conditioned on compliance with the legal document and unlawful detainer assistant chapter.

Who needs it
Individuals, partnerships and corporations registering as California unlawful detainer assistants. The statutory definition concerns paid assistance in prosecuting or defending an unlawful detainer claim or action.
Who it protects
The bond is in favor of the State of California for people damaged by a registered assistant’s chapter violation, fraud, dishonesty or incompetency. It must identify the county where it will be filed.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Use the registration’s required amount

An individual’s bond is $25,000. For a partnership or corporation, Section 6405 bases the bond on the combined number of legal document assistants and unlawful detainer assistants: $25,000 for one to four, $50,000 for five to nine, and $100,000 for ten or more.

An employee’s registration needs a separate $25,000 bond only if the partnership or corporation has not posted the required business bond. Have the employer’s registration and bond details ready rather than assuming every employee must buy another instrument.

Apply and file in the correct county

Purchase Now opens Propeller in a new tab. Use the legal registrant name, individual or business capacity, assistant count, filing county and required dates from your registration application.

After issuance, provide the bond with the registration application to the county clerk. Section 6405 directs the clerk to send the filed bond to the recorder. Check the county name on the instrument before filing; bond purchase does not complete the registration.

Questions about this bond

Is $25,000 correct for every applicant?

No. It is the individual sum and the business sum for one to four assistants. Larger partnerships and corporations have the higher tiers listed in Section 6405.

Does an employee always need another bond?

Section 6405 requires an employee’s separate $25,000 bond only when the partnership or corporation has not posted its required business bond. Check that evidence against the county registration.

Should the bond name the state or the county?

The statute puts the bond in favor of the State of California and also requires the name of the filing county. Follow the county’s accepted wording for both.
