Cayuga County, NY — Highway Permit Bond

For work affecting a Cayuga County road, use the County Highway Superintendent's right-of-way permit instructions. The 2026 form distinguishes pavement cuts, work without pavement disturbance, and an annual arrangement for emergency utility breaks.

What this bond does

Provide the performance security requested for a County highway right-of-way permit under Highway Law Section 136. It supports the approved installation, restoration, and maintenance obligation rather than a general contractor license.

Who needs it
Applicants installing or repairing utilities or other items under, on, or above a Cayuga County road right-of-way. Confirm County jurisdiction; a local street or State highway request uses its own authority's requirements.
Who it protects
The County form addresses maintenance of an approved cut, repair of damage, compliance, and removal following noncompliance. Its certified-check or performance-bond provisions are tied to the particular permitted work.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Pavement disturbance changes the security

The County form normally requires work beneath pavement to use methods that avoid cutting it. An open cut is allowed only in rare instances with strong justification. If approved, the form requires a certified check or an authorized New York performance bond before permit receipt and work.

The schedule lists $3,750 for new-utility pavement cuts and $1,250 for repair or maintenance of buried utility breaks. Other activities have different entries, including some with no deposit. Have the Superintendent assess the actual work rather than using one amount for every permit.

Security release follows the inspection category

For work without pavement disturbance, the schedule describes return after completion notice and Highway Department inspection. For pavement cuts, it describes return three years after the completion inspection. Required signed record drawings must also be received before release.

The form separately allows an annual permit for emergency utility breaks, with the repair/pavement-cut security amount. The County must be notified of a utility-break excavation during working hours that day or the next working day; the annual permit is not permission to omit notification.

Prepare the permit and bond together

Provide the exact work location and a map or sketch with measurements tied to a permanent feature. Plans are required for installations under, on, or above the right-of-way, and the Superintendent may require engineer certification and insurance.

Confirm the assessed amount, principal, accepted wording, and scope before continuing through Propeller. File the issued document as the Superintendent directs and obtain the permit before work. Do not treat three years from purchase as the County's pavement-cut release schedule.

Sources

Have these ready

  1. Confirm County road jurisdiction and the proposed work method, including any requested open-cut exception.
  2. Prepare measured location drawings, installation plans, and the work description.
  3. Obtain the Superintendent's activity classification, security amount, accepted form, and principal requirements.
  4. Identify inspection, as-built drawing, ongoing-maintenance and release conditions.

Questions about this bond

Can I plan an open cut as the default crossing method?

The County's form normally requires installation beneath pavement without cutting it. An open cut needs the Superintendent's approval based on strong justification.

When is pavement-cut security returned?

The schedule describes three years after the completion inspection, with required signed record drawings received. That is not a three-year period measured from bond purchase.

Does an annual utility-break permit eliminate County notification?

No. Its note requires notice during working hours on the excavation day or the next working day and states that failure to notify voids the permit.
