New York — DOT Right Of Way Permit (PERM 44) Bond

Use NYSDOT's PERM 44 when the State Department of Transportation requests performance security for work affecting a State highway. Obtain the issuing office's amount and principal instructions before applying; the official form leaves the bond amount to be completed for the approved requirement.

What this bond does

Secure timely, workmanlike completion of the permitted State-highway work and restoration under NYSDOT's PERM 44. This State instrument differs from New York City's DOT permit bonds and from local highway security.

Who needs it
Parties arranging approved drive entrances, utility installations, intersections, curbs, sidewalks, drainage, or other work within NYSDOT jurisdiction. Confirm the required principal separately from any engineer or contractor applying as an agent.
Who it protects
The form permits NYSDOT to require completion or reimbursement up to the bond amount and contains State indemnity and highway-restoration obligations. These relate to the permitted highway work, not automatically every obligation in an applicant's broader construction contract.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Use the State's form and assessed amount

PERM 44 names the New York State Department of Transportation as recipient and asks for the principal's legal identity, amount, effective date, and execution. For a DBA, it also requests the legal entity and assumed-name documentation.

The form does not publish one universal minimum. NYSDOT's non-utility submission requirements state that the Department determines required site-restoration security and describe bond, deposit, letter-of-credit, and applicable undertaking alternatives. Do not assume every applicant can substitute every instrument.

The surety application is separate from PermiTrack

Confirm the work location by State route and reference markers, municipality and county, scope, plans, schedule, and security instructions with the issuing office. Use the existing Propeller application for the bond once the requirement matches.

For non-utility permits, the current checklist directs the permit application and supporting material through PermiTrack. PERM 44 execution also requires the surety's authority and supporting attachments. Submit the issued bond as NYSDOT directs rather than treating the provider application as a highway permit application.

Completion and acceptance control the stated duration

The form states that it remains in force until the work is satisfactorily completed and accepted. It does not establish an automatic one-year end or a routine cancellation deadline.

Obtain the separate highway-work permit and comply with its commencement, inspection, insurance, and restoration conditions. The non-utility terms also preserve maintenance and repair responsibilities after completion; ask the issuing office for the acceptance and release steps for your work.

Sources

Have these ready

  1. Confirm NYSDOT rather than NYC DOT or a local highway authority.
  2. Obtain the assessed amount, accepted PERM 44 execution requirements, principal and effective date.
  3. Prepare State-route location, plans, work description, schedule, and applicable insurance documents.
  4. Coordinate the surety's attachments and separate permit submission, inspection, acceptance and release instructions.

Questions about this bond

Is PERM 44 the New York City permit bond?

No. PERM 44 names the State Department of Transportation and concerns State-highway work. NYC DOT has different permit bond forms.

What amount should I enter?

Use the amount required by the NYSDOT issuing office. The official PERM 44 form has a blank amount, and the non-utility terms place the required site-restoration security amount with the Department.

Does the form expire a year after issuance?

The stated duration is until satisfactory completion and acceptance of the work. Confirm your issued instrument and the office's release process rather than inserting an unsupported annual term.
