Florida — 10th Judicial Circuit Court Process Server Bond
Applying to serve civil process in Polk, Hardee or Highlands County? The Tenth Circuit prescribes a $5,000, one-year bond in Attachment 4 of its current process-server order. The Southern Agency’s listing concerns that individual court certification. Use the Tenth Circuit’s form and filing instructions rather than a form for another Florida circuit.

What this bond does
The prescribed form names the Governor of Florida as obligee for the benefit of people wrongfully injured by the applicant’s malfeasance, misfeasance or negligence in process-server duties. Its condition is faithful performance of the office as prescribed by law.
- Who needs it
- The individual seeking or maintaining Tenth Judicial Circuit certified-process-server status. The court’s program covers Polk, Hardee and Highlands Counties and non-enforceable civil process in actions filed in the circuit. A service company’s business name does not replace the individual applicant.
- Who it protects
- The $5,000 obligation concerns wrongful injury connected with process-server duties and faithful performance. It does not guarantee a favorable lawsuit outcome, authorize enforcement of a writ or give a purchaser automatic authority to serve statewide. The Chief Judge’s certification and current approved-list status remain separate.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Questions about this bond
Is the Governor or the Court Administrator the named recipient?
Attachment 4 binds the principal and surety to the Governor of Florida for the stated injured-person benefit. The order directs filing with the Office of the Court Administrator. Follow both instructions rather than replacing the obligee with the filing office.
Does five-year certification mean a five-year bond?
No. The prescribed bond form is for one year and permits continuation certificates. The five-year certification depends on annual ID renewal, good standing and a current bond; after five years the order requires reapplication.
Does buying this let me serve anywhere in Florida?
No. The Tenth Circuit’s program addresses certified servers in Polk, Hardee and Highlands for the non-enforceable civil process described in its order. Court approval and current approved-list status are required; another circuit’s appointment cannot be assumed.
