Florida — Pawnbroking Bond

Florida’s pawnshop financial qualification allows verified net worth of at least $50,000 or specified $10,000 security for each licence. A surety bond is one security option, alongside an accepted letter of credit or certificate of deposit. The Southern Agency’s listing concerns the FDACS pawnbroking surety route.

What this bond does

Section 539.001(4) places the instrument in favor of the Florida Department of Agriculture and Consumer Services for consumers injured by the pawnbroker’s fraud, misrepresentation, breach of contract, financial failure or violation of that section.

Who needs it
The actual pawn-license applicant using the financial-security route. Match the individual/entity licensee and licensed premises rather than substituting a manager, employee or trade name alone. A verified net-worth applicant should not assume this purchase is compulsory just because the business is a pawnshop.
Who it protects
The posted security benefits injured consumers through FDACS-adjudicated claims. It is not shop inventory insurance or an automatic payment whenever a complaint is made. Aggregate awards cannot exceed the security sum and the Department determines the applicable distribution.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Confirm the financial path before applying

FDACS’s current guidance gives the $50,000 net-worth or $10,000 bond/letter-of-credit/certificate-of-deposit choice. The statute specifies $10,000 for each licence on the security route and evidence for an applicant relying on net worth. Do not assume one unlabeled public option covers every location.

Other applicant qualifications and licensing review remain separate. Keep the legal licensee, actual licensed premises and Department request together; buying the instrument does not establish net worth or complete FDACS approval.

Understand the Department’s role in claims

The statute allows underlying liability to be pursued administratively or through a civil case, but it reserves enforcement of the posted security to the Department’s administrative process. A civil judgment does not itself authorize direct execution against this posted instrument.

Claims must follow the prescribed process and be adjudicated by agency order. The statutory aggregate cap and possible pro-rata distribution are important: $10,000 is not a new separate limit for every customer, item or allegation.

Use the State request and current filing instructions

The statute calls for the original security on the agency-adopted form, with FDACS as beneficiary. The current programme points to the Department’s new ConsumerCompliance registration portal. Follow FDACS’s current instructions for the security document and licensing file; do not assume a portal account or provider PDF completes both.

Purchase Now opens RLI in a new tab. Compare the actual licensee/premises, FDACS recipient, requested $10,000 security, accepted form, and dates before completing the application. The public option supplies no term label. FDACS describes annual licensure and continued financial qualification; match the actual accepted instrument and renewal instructions.

FDACS expressly says a pending application after licence expiry is not authority to continue pawning. Keep the licence and required financial qualification current rather than treating purchase or an unprocessed renewal as permission to operate.

Questions about this bond

Must every Florida pawnshop purchase a surety bond?

No. Current FDACS guidance and Section 539.001 provide a verified-net-worth path or specified security. A bond is one permitted security form; accepted letters of credit and certificates of deposit are alternatives. Use the actual Department request and financial qualification.

Does one $10,000 sum automatically cover all my locations?

The statute specifies $10,000 for each licence on the security route. Match the actual licensee and licensed premises with FDACS; do not infer multi-location coverage from the single public option.

Can I keep pawning while an expired licence’s renewal is pending?

FDACS’s current FAQ says no: a valid FDACS licence is necessary. A pending application or a purchased surety document does not by itself authorize continued pawn operations.
