What this bond does

Match the TWD business and Chapter 210, Part II condition to ABT's current request. Cigarette-distributor percentages and the older general-package table should not determine this account's amount.

Who needs it
Businesses applying for a Florida tobacco-products distributor license or renewing its required security. Establish the actual TWD activity and each business place; the cigarette classes use different provisions.
Who it protects
Section 210.40 requires security for taxes, penalties and accrued interest due Florida. The posted ABT-6032 additionally states operational-tax accounting/payment and compliance with the selected tobacco-products laws in Part II, binding the principal and surety jointly and severally to the state.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for current Florida tobacco-distributor security

The current statute specifies a $25,000 initial corporate surety bond from an authorized surety in a Division-prescribed form. ABT reviews adequacy semiannually and may increase security before renewal or after that review.

The statute ties a possible increase and renewal amount to the distributor's highest month of final audited tax liabilities, penalties and accrued interest. Obtain ABT's actual written requirement; neither a flat initial sum for every renewal nor the old package's $1,000 entry settles it.

A reduction requires ABT's good-cause determination. The statute describes at least four years of responsible reporting/payment and monthly audited exposure below the bond. Default, unresolved criminal or administrative proceedings and specified pending investigations can prevent reduction; four years passing alone does not release security.

A separate license application is required for each business place, but section 210.40(7) permits one corporate surety bond in a Division-determined amount for all the distributor's applications. Do not assume each location automatically multiplies the initial sum or that a single bond is accepted without ABT's determination.

Select the tobacco-products distributor classification and Part II condition on the accepted instrument. The posted ABT-6032 model has sixty days' written surety-cancellation notice to the Division and preserves covered earlier acts. Complete the sworn application, required execution and properly certified surety-agent power of attorney using current filing directions.

Purchase Now opens Propeller's Florida tobacco-distributor application in a new tab. Match the TWD applicant, places of business, current ABT-assigned sum and accepted period, then complete security/license filing and tax-reporting steps. Provider payment does not issue the license, approve a reduction or settle tax liabilities.

Questions about this bond

Should I use $1,000 from the older ABT table?

The current section 210.40 initial requirement is $25,000. Use ABT's current request and the current law rather than that older package row.

Does each location automatically need another $25,000 bond?

Each business place needs a license application, but the statute allows one Division-approved bond in its determined amount for all applications. Obtain the actual determination.

Is a reduction automatic after four years?

No. ABT must determine good cause under the statutory financial/compliance criteria, and specified defaults or unresolved proceedings/investigations prevent reduction.
