Geneva, IL — Right Of Way Permit Bond

Geneva distinguishes excavation/restoration work from its minor non-excavation category when setting ROW warranty/maintenance security. Its current guidance also allows bonds to cover all ROW projects for two years; confirm the accepted arrangement rather than assuming one bond per job or automatic expiration.

What this bond does

Warranty/maintenance security for the contractor's approved Geneva right-of-way work and the duties in the accepted City instrument.

Who needs it
The legal contractor/principal required by Geneva, coordinated with the owner or permit applicant and Public Works Engineering.
Who it protects
The City's posted example includes permit compliance, restoration, associated payments and replacement of defective work. The executed instrument controls; this is not a universal promise about every part of a construction project.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Let the work determine the requested security

The requirements sheet lists $20,000 warranty/maintenance security for excavation or penetration of ROW surfaces requiring restoration or landscaping. It lists $10,000 for its non-excavation/minor-work category, with examples including same-size driveway repaving, dumpsters, pods and parkway trees. The Public Works Director has final authority over type and amount, and the City's main guidance reserves additional security for large projects. Have the City classify your work rather than choosing the smaller amount from a project label alone.

Confirm project coverage and the actual release terms

The City's main guidance allows bonds to apply to all ROW projects for a two-year period. Its posted example is continuous until cancellation, nonrenewal or City release and includes 30-day surety cancellation notice without erasing accrued liability. The example leaves the defective-work replacement period blank. Do not fill that blank with the separate two-year project-coverage policy or assume the posted example fixes this provider's term.

Purchase Now opens Propeller; the option displays no fixed amount or term. Supply the City's accepted form, legal principal, recipient, amount and dates. Separately prepare existing/proposed plans, applicable insurance and an approved traffic plan for lane closures or detours. Arrange issuance, City filing and permit approval, then required inspections; purchasing security does not authorize work.

Questions about this bond

Does every Geneva ROW project require $20,000?

The requirements distinguish $20,000 excavation/restoration work from a $10,000 non-excavation/minor-work category. The Director determines the actual type and amount and may require additional security for large projects.

Can one bond cover more than one project?

The City's main guidance allows all ROW projects to be covered for two years. Confirm that the actual accepted instrument and provider issuance establish the arrangement you need.

Is the two-year policy the defective-work period or an automatic release?

Not necessarily. The posted example leaves the defect-replacement period blank and separately addresses continuous force, cancellation and City release. Obtain the actual completed terms rather than combining those different provisions.
