Georgia — Hemp Processor Bond

Georgia's hemp processor bond secures faithful accounting and payment to licensed hemp growers for purchased hemp, along with compliance with the Hemp Farming Act. Use the Agriculture Commissioner's required amount and accepted form. The published minimum is $20,000, but that is not automatically every processor's requirement.

What this bond does

Secure the processor's accounting and payment obligations to hemp grower licensees and its compliance with Georgia's Hemp Farming Act.

Who needs it
Georgia hemp processor permit applicants and permittees maintaining or replacing required security. A business that both grows and processes hemp needs the separate grower license and processor permit described by GDA.
Who it protects
Section 2-23-6.1 protects faithful accounting and payment to licensed growers and chapter compliance. A person claiming damage from a bond breach may file a written complaint with the Agriculture Commissioner within 180 days of the alleged breach; separate statutory enforcement and court-action procedures apply.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for grower accounts and continuous security

The Commissioner determines the required amount. The statute and current rule state a $20,000 minimum, a $1 million maximum and a constraint tied to 2% of the most recent calendar year's hemp purchases from grower licensees. The rule assigns the minimum when there is no purchase history. Provide the actual purchase records and obtain the Commissioner's determination rather than assuming a fixed amount or calculating a new catalog option.

The bond must use a Commissioner-prescribed or approved form and a Georgia-authorized surety corporation approved by the Commissioner. The statute requires the surety's Insurance Commissioner good-standing certificate with bond applications. This is distinct from the processor business's own organizational documents.

If the surety becomes disqualified in Georgia, the rule requires an approved replacement of at least equivalent amount within 30 days, effective from the date the previous bond became ineffective. That is not a general 30-day cancellation notice provision. Cancellation, failure to replace a disqualified surety or failure to meet a required additional-bond demand can cause immediate permit revocation and a four-year reapplication bar. Coordinate continuity with GDA before ending coverage.

GDA handles processor applications and renewals through its hemp licensing system. Its permit year ends December 31 and renewals open in November; those dates do not establish the bond's expiration. Keep the bond evidence, grower purchase records and any written additional-security demand aligned with the actual permit. A bond does not issue a grower license or other hemp-business approval.

Questions about this bond

Is every Georgia processor required to buy exactly $20,000?

No. That is the published minimum. The Commissioner determines the requirement under the statute and rule using the stated bounds and purchase information. The rule uses the minimum for a processor without purchase history; match the Department's actual determination and any additional-security demand.

Can I cancel the bond while keeping the processor permit?

Do not assume that. The statute and rule attach immediate permit-revocation consequences to cancellation and specified failures to maintain replacement or additional security. Plan any change with GDA; the rule's 30-day disqualified-surety replacement provision is not an ordinary cancellation notice period.
