What this bond does

Secure the adult-use dispensing organization's construction, continuous supply, renewal, records, reporting, State-tax and operating obligations described in section 15-55 and the accepted bond.

Who needs it
Illinois adult-use dispensing organizations using a surety bond to meet IDFPR's financial-responsibility requirement. Use the adult-use form for the actual license; the Department separately publishes medical-dispensary forms.
Who it protects
The published adult-use form names Illinois IDFPR's Division of Professional Regulation as obligee for losses from violations of license conditions. After the stated hearing and finding of failure to comply, the Division may proceed against the principal, surety or both. The model caps aggregate liability at $50,000 across claims, years and license renewals.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for the approved form and license record

Section 15-55 of the Cannabis Regulation and Tax Act permits a Department-approved $50,000 escrow or surety account, or a $50,000 surety bond. For the bond route, the business name and registration number must correspond exactly with Department records, the form must be approved, and a copy must be received within ninety days after the effective date. Follow the actual financial-assurance path rather than assuming an application payment completes it.

The published adult-use bond covers timely dispensary construction, an uninterrupted supply of cannabis, renewal fees, accurate records, required reports, State taxes and conformity with the Act and rules. It is not a general guarantee to individual customers or a substitute for every cannabis-business account's separate security.

The model is continuous and requires certified-mail cancellation notice to both the Division and principal at least thirty days before the stated termination date. Discharge concerns acts or omissions after termination; earlier liabilities are not automatically erased. The statute warns that failure to file replacement security by cancellation can lead to permanent revocation. Keep replacement and receipt records.

Use the Department's currently accepted license period and form instructions. The published model retains a 2021 initial-license date example, which should not be treated as your present effective date. Its terms may not be amended without the Division's prior written consent, and its aggregate amount does not replenish merely because the license is renewed.

Questions about this bond

Does a slightly different business name work?

Section 15-55 requires the business name and registration number on the bond to correspond exactly with Department records. Resolve the record or execution mismatch before filing; a familiar trade name alone is not the statutory match.

Does each renewal create another $50,000 limit?

The published model caps aggregate liability at the bond amount regardless of years, premiums, license renewals, claimants or claims. It is continuous until terminated under its terms, rather than a fresh limit automatically created each renewal.
