Iowa — Cigarette Wholesaler Permit Bond

Iowa's current rule sets the cigarette-wholesaler bond at $2,500. Confirm that your business performs the wholesaler function before applying; a warehouse moving cigarettes only to its own retail stores does not qualify on that activity alone.

What this bond does

The bond supports an Iowa state permit for cigarette wholesaling. The statute's general $500 state-permit minimum is not the wholesaler's current rule amount, and Revenue must approve the security before issuing the permit.

Who needs it
Businesses selling or distributing cigarettes within Iowa for resale, other than businesses acting as distributors or distributing agents. Revenue's rule distinguishes sales between separate businesses from transfers within the same company.
Who it protects
Section 453A.14 makes the bond payable to Iowa and conditions it on payment of taxes, damages, fines, penalties and costs adjudged against the permit holder for violating the cigarette subchapter. It protects the state, rather than insuring the wholesaler's goods or unpaid customer accounts.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for Iowa cigarette wholesalers

Rule 701—231.3 specifies $2,500 for a wholesaler permit. Use that class and Revenue's required amount rather than treating the statute's $500 floor as the applicable order amount. The Director can require increased or replacement security when an existing bond becomes insufficient or its surety unsatisfactory.

A retail chain's warehouse does not become a wholesaler merely by storing cigarettes and transferring them to its own outlets. Rule 231.2 gives that example expressly. Describe your actual buyers, sales and business entities so Revenue can determine the correct permit.

Identify every business location and any additional functions. If you operate as both distributor and wholesaler at the same place, section 453A.13(8) requires one state permit there; retail sales require a separate retail permit. Do not automatically add two wholesaler/distributor bond amounts for that same-place arrangement.

Where additional permit types are genuinely required, the rule permits separate bonds or an eligible bond covering the aggregate requirement. Confirm the accepted combination with Revenue. A wholesaler permit does not automatically authorize another regulated distribution or retail activity.

Subchapter permits expire June 30. Current sections 453A.13 and 453A.14 require electronic application documents and bond filing on the Department's prescribed forms. Keep the approved security current and follow Revenue's execution and renewal directions. The ten days in section 453A.14 concern responding to a demand for new or additional security, not an ordinary cancellation notice.

Questions about this bond

Is the wholesaler bond $500 or $2,500?

The statute sets a general state-permit floor of $500, but current rule 231.3 sets the wholesaler amount at $2,500. Use Revenue's required security for the actual wholesaler class.

Does my own retail warehouse qualify?

Not merely because it stores cigarettes and transfers them to your own stores. Revenue's rule treats those transfers differently from sales or distributions between separate businesses.

Do I need two state permits if I also distribute at the same place?

Section 453A.13(8) provides one state permit for combined distributor and wholesaler operations at the same place. Retail activity is separate. Have Revenue confirm your actual permits and required security before combining amounts.

Can I start selling once I pay for the bond?

No. The state permit must be obtained and remain unrevoked and unexpired. Complete the Department's application and acceptance process separately from the provider's bond application.
