What this bond does

Section XII of the published May 2005 regulations calls for security sufficient for reclamation, permit compliance and inspections, determined by the Planning Board and submitted to the Selectmen before permit grant or opening a new overburden area. The current project request must establish the accepted instrument and legal recipient.

Who needs it
The property owner or agent designated in writing in the excavation application, as defined in the published regulations. The Board determines applicability/exceptions; ordinary construction-related digging is not automatically the commercial operation described by this program.
Who it protects
Reclamation includes site-specific soil/vegetation, slope and drainage work. Section XII permits approved security forms and phasing; transport-related damage to town roads/facilities is to be discussed at that stage, not assumed to be an unlimited road-damage promise in every bond.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Match security to the approved reclamation phase

The published text allows approved phased security sufficient for the applicable section, requires new security before opening a new section and makes release subject to Board satisfaction with reclamation-plan conditions. Completing digging is not by itself release approval.

The May 2005 document also treats permit duration, reclamation timing and incremental reclamation separately. Do not convert those periods into a universal bond expiry. Confirm today's accepted request, amount, principal/recipient, form and phase/release instructions rather than treating an older published regulation as fresh legal certification.

Sources

Have these ready

  1. Identify the regulated excavation area, material removal and actual permit/exception determination.
  2. Have the excavation and reclamation plans, phase boundaries and timetable.
  3. Confirm owner/authorized-agent role and the Town's required bond principal/recipient.
  4. Obtain the current security determination, accepted form, amount, dates and phase/release instructions.

Questions about this bond

Is every building-site excavation covered by this program?

The published regulations define commercial earth excavation and include exceptions for specified incidental construction and other activities. Use the Board's project determination, not the bond title alone.

Can a phased bond be released just because digging stops?

The published phasing provisions still require Board satisfaction with reclamation conditions and new security before the next section opens. Stopping excavation is not automatic release.

How do I start the surety application?

Select Purchase Now to open Propeller in a new tab. Check the Town's actual reclamation request, legal principal/recipient, covered phase, accepted form, amount and dates. Provider review/issuance, execution and Town filing do not grant the excavation permit or reclamation approval.
