Lockport, NY — Street Opening Bond

For City of Lockport water or sewer work involving a street opening, the amended code calls for a $25,000 bond on file with the City Engineer before permit issuance. Use the current requirement, not the different amount and maintenance period in an older downloadable form.

What this bond does

Secure restoration of the right-of-way disturbed by the City's approved opening under Section C-370a. Confirm the applicable City programme and accepted wording for the actual work; Town of Lockport roads and other authorities' openings require their own instructions.

Who needs it
Applicants tapping, altering or installing water or sewer facilities within City street rights-of-way. The application identifies the work, particular location, applicant and any authorized representative.
Who it protects
Section C-370a.20 secures restoration at the permittee's expense and continuing liability after the last permitted work. It does not grant water/sewer or street-work permission or replace the City's separate insurance requirements.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Use the amended restoration requirement

The code displays an April 27, 2022 amendment. Paragraph 20 requires $25,000 in force and on file with the City Engineer before the street-opening permit is issued.

It requires restoration no later than seven days after work completion and the bond to remain effective for three years after completion of the last work under a permit during its stated term. Do not use an older $5,000, one-year form to set this obligation.

The City must approve the work and location

For the water/sewer street-opening programme, the permit is signed by the City Engineer and Superintendent of Streets. All locations need approval, and the stated work must begin within ten days of the permit unless the City Engineer approves an extension.

The code distinguishes unpaved restoration by the permittee from City backfilling/repaving of paved openings at the permittee's expense, with additional provisions for multiple lines in one opening. Obtain the actual restoration arrangement and inspections rather than assuming the contractor closes out everything independently.

File the surety before obtaining the permit

Confirm the principal, $25,000 form, dates, execution and continuing-work wording with the City Engineer before using the existing Propeller application. Submit the issued instrument as directed and arrange the separate insurance and work documents.

Obtain the signed permit before ordinary work starts. Emergency openings have their own temporary-authorization process and later formal application; neither purchasing the bond nor calling a job urgent supplies that authorization.

Sources

Questions about this bond

Can I use the older $5,000 street-opening amount?

For the amended City Section C-370a programme, paragraph 20 states $25,000 and a three-year post-last-work period. Obtain the City's current accepted form rather than relying on the older download.

Does the three-year period start when I buy the bond?

No. The stated provision measures it from completion of the last permitted work during the bond's stated term. Confirm the actual issued wording and City release process.

Can I start an emergency opening without City authorization?

The code provides temporary authorization by the City Engineer or an authorized representative, followed by a formal application when the office opens. Buying a bond does not replace that process.
