Nassau County, NY — Road Opening Permit Bond

Nassau County's published road-work rules allow a performance/road-opening bond when the assessed restoration deposit exceeds $25,000. Have County Public Works review the plans and confirm the security before applying; this is not a flat $25,000 bond for every opening.

What this bond does

Secure the accepted restoration obligation for work on a County road or within County right-of-way. The County's permit page currently links its 2016 rules and separate residential and commercial applications.

Who needs it
Owners, contractors, utilities and other applicants proposing overhead, surface or underground work in Nassau County's road right-of-way. A Town or Village location does not by itself identify who controls the affected road.
Who it protects
The published rules address restoration, County supervision and necessary repairs, and indemnification of Nassau County. The accepted security does not replace liability insurance or permissions from other authorities.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Obtain the assessed restoration security

Public Works calculates the restoration deposit after reviewing the application and plans. Its linked rules accept a performance/road-opening bond instead of the deposit check when the calculated deposit is over $25,000; they also address utility companies whose aggregate work exceeds that threshold.

The bond must indemnify and hold harmless Nassau County and remain effective for at least two years. Confirm the assessed amount, accepted wording, principal and dates rather than treating the eligibility threshold as the required sum.

Prepare the County plans and other approvals

The rules request plans showing proposed work and existing right-of-way features, utilities and restoration details, including trench cross-sections. Choose the residential or commercial County application that fits the work.

Within incorporated villages and cities, the rules call for those municipalities' permits or approvals before the County application. County authorization also does not waive other agency permits, insurance or traffic-control requirements.

Arrange issuance, work authorization and closeout separately

After Public Works confirms the surety requirement, use the existing Propeller application. Check the executed instrument and submit it as the County directs; obtain the approved work permit and coordinate required notices before starting.

The rules separately describe at least two years of bond effectiveness and one year of failed-restoration maintenance after acceptance of permanent restoration. Those are different periods. Confirm the actual instrument's dates and release process rather than assuming permit completion releases the surety.

Questions about this bond

Is $25,000 the bond amount for every Nassau opening?

No. The published rules use a deposit exceeding $25,000 as a condition for accepting a bond instead. Public Works assesses the actual security after reviewing the plans.

Does a County bond replace a Town or Village permit?

No. Confirm all authorities involved. The County rules specifically require prior municipal approvals within incorporated villages and cities and preserve other permit obligations.

Does the one-year restoration guarantee make this a one-year bond?

No. The linked rules separately require the accepted bond to be effective for at least two years. Confirm its dates and release with Public Works.
