What this bond does

The bond protects the IUOE Local 825 Employee Benefit Funds by guaranteeing the payment of fringe benefit contributions for employees performing covered work. It provides a source of collection for the Obligee should an employer default on their payment obligations defined in the collective bargaining agreement.

Who needs it
Employers who are signatories to a collective bargaining agreement with the International Union of Operating Engineers Local 825 and are required by that agreement to secure their fringe benefit payment obligations.
Who it protects
The bond protects the IUOE Local 825 Employee Benefit Funds, which include the Pension Fund, Welfare Fund, Apprenticeship Training and Re-Training Fund, Supplemental Unemployment Benefit Funds, Savings Fund, and Profit Sharing Fund.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Contribution security and the bond limit

The Funds' 2025 form specifies $25,000 of security, with the surety's liability limited to that sum across the bond and its continuations. It stays in force until terminated under its terms. Termination requires at least 60 days' written notice to the employer and the Funds and preserves liability for delinquencies accrued before termination.

The surety is bound independently of the employer for delinquent fringe benefit contributions. Paragraph 6 also addresses interest, liquidated damages, arbitration awards and statutory additions. Paragraph 13 provides for a further 35% of the recovery as liquidated costs and fees if the Funds bring suit or arbitration; review the complete wording rather than treating the bond amount as the employer's total liability.

Default, notices and collection

Paragraph 3 calls for payment to the Funds within 30 days after they notify the surety of delinquent contributions. For purposes of this bond, paragraph 7 deems the employer in default when an arbitration award declares that it owes contributions to the Funds.

Paragraph 7 requires the Funds to notify the surety within 90 days after learning of the default and to start proceedings within one year after expiration or cancellation. It also contains a statutory time-limit exception. Notices must follow paragraph 4; this summary does not replace those instructions.

Agreement changes and continuation

The published form says renewal, extension or modification of the collective bargaining agreement does not invalidate the bond. Execution or extension of another agreement continues it in force. Those provisions do not establish a fixed annual bond term or remove the surety's termination rights.

Paragraph 1 calls for an original continuation certificate or updated bond at expiration, in the form the Funds require. The surety may request an agreement that changes contribution rates. Keep agreement updates, contribution reports and continuation documents together.

Start the application, then arrange execution

Purchase Now opens Propeller's application in a new tab. Enter the employer details and provide the Funds' requested form and agreement information. Starting or paying for an application does not establish issuance or acceptance by the Funds.

After issuance, review the bond and complete the employer and surety signatures and acknowledgments the form requires. Paragraph 12 permits identical counterparts and facsimile signatures. Follow the Fund Administrator's delivery instructions and retain the acceptance record.

Questions about this bond

What happens if my company fails to file remittance reports?

Under paragraph 10 of the 2025 form, missing reports do not prevent collection. The Funds may estimate hours using the highest reported month in the preceding 12 months and apply the current contribution rate, plus interest and other damages.

Are partial or multiple claims allowed under this bond?

Yes, partial and multiple claims are permitted, provided the aggregate total of all claims does not exceed the $25,000.00 bond amount.

Can the Surety terminate the bond at any time?

Paragraph 5 of the 2025 form requires at least 60 days' written notice to the employer and the Funds, delivered as paragraph 4 directs. Termination leaves the surety liable for covered delinquencies that accrued before the termination date.

Is this the same as ERISA fidelity or employee insurance?

No. This bond secures the employer's contributions to the Local 825 Funds. ERISA fidelity coverage concerns dishonest handling of plan assets, employee insurance supplies benefits, and a construction payment bond secures project payment obligations.
