New York — Third Party Commercial Driver License (CDL) Skills Testing Bond

New York DMV requires non-government Third-Party CDL Testing entities to maintain a $20,000 surety bond. Apply as the actual testing entity, called the AGENT in the program, and match its DMV memorandum. A driving school or for-hire training/testing business cannot test someone trained by that entity, even through a different examiner.

What this bond does

Maintain the non-government testing entity's required security under its New York DMV Third Party CDL Testing Program memorandum.

Who needs it
The entity applying to conduct class A, B or C CDL skills tests for employees or customers. Its proposed examiner list, testing site and route form part of the application; approval remains with DMV.
Who it protects
The current DMV program operates under 49 CFR 383.75, whose security condition pays State re-testing costs after the tester or its examiners engage in skills-testing fraud. Match the non-government entity's $20,000 requirement and the full DMV-accepted undertaking; do not treat employee examiner training as the entity's security.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for the AGENT and training restrictions

The entity applies through DMV's online Application for Conducting Third-Party Skills Testing. Prepare the proposed examiners, site and road route. An accepted applicant must sign the memorandum supplied by DMV; the non-government entity must maintain its required $20,000 security.

After application acceptance, the entity develops its basic-control-skills site and detailed road route with DMV assistance to meet State and federal standards. Approved examiners attend DMV-provided road-test training. Buying security does not complete those stages.

For a driving school or for-hire training/testing entity, the restriction is entity-wide. Another examiner employed by the same entity cannot test a person whom that entity trained. Do not assume separating the instructor and examiner within the school solves New York's restriction.

DMV says a driving school or for-hire operation acting as a third-party testing entity may also need Private Service Bureau authorization. Confirm that additional requirement with the Department's partnering program; the bond application does not supply it.

Have DMV and the provider match the legal entity, actual government/non-government status, full accepted undertaking, effective dates, execution and continuation. Use the filing instructions associated with the accepted memorandum and keep the examiner qualifications, site and route approvals current.

Questions about this bond

Can another examiner at the same driving school test someone the school trained?

DMV's current program says no. For a driving school or for-hire training/testing entity, its examiner cannot test someone trained by anyone employed by that entity. The restriction is not limited to the particular instructor.

Does the bond grant Private Service Bureau authorization?

No. DMV says a driving school or for-hire operation acting as a testing entity may need that separate authorization. Confirm the actual requirement with DMV's partnering program.
