Nixa, MO — Right Of Way Encroachment Bond

Nixa's encroachment process covers digging, trenching or cutting for driveway approaches, sidewalks and utility work in City ROW, easements or public property after the original improvements have been accepted. The City lists a $5,000 construction bond payable to the City of Nixa with the permit application. State highways, Christian County roads and original approved development infrastructure are different obligations.

What this bond does

Provide the construction security requested for a Nixa encroachment permit, matched to the particular work and City-accepted form.

Who needs it
The named encroachment applicant responsible for the proposed work, with owner, contractor and utility roles identified.
Who it protects
The City's construction security supports the accepted encroachment undertaking. It does not itself authorize digging or replace the required insurance and permit approval.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Check the location and stage of the work

The City's encroachment guidance applies after original improvements are complete, the final plat is recorded and the City has accepted them. It excludes utility and infrastructure work being installed under approved original development construction plans.

Identify the affected driveway approach, sidewalk or utility facility and the proposed cut, trench or excavation on a detailed site map. A Nixa address alone does not establish City authority over a state highway or Christian County road.

Arrange security without confusing it with the permit

Nixa lists a $5,000 construction bond payable to the City at application submittal, with cash or check alternatives. Purchase Now opens the existing Propeller application; its option supplies no fixed amount or term. Give the issuer the City's actual request, legal principal, work location, assigned dates and accepted form before issuance.

The City directs permit applications through myNixa. Confirm executed-bond delivery separately, supply the required insurance and obtain the actual permit. The City's 30-day start and 60-day completion provisions run from permit issuance; they are not published bond terms.

Complete the permitted work and obtain City approval. The City's discussion of returning security after satisfactory completion is not a promise that a surety premium will be refunded.

Questions about this bond

Does this replace a MoDOT or Christian County requirement?

No. Nixa's published ROW definition excludes state highways and Christian County roadways. Match the security to the authority controlling the work.

Are 30 and 60 days the bond term?

No. They are the City's permit start and completion provisions. Obtain the bond dates and any notice conditions from the accepted instrument.

Can I start after purchasing the bond?

Purchase and issuance are separate from City permit approval. Complete the City's application, insurance and security steps and obtain authorization before work.
