North Carolina — Investment Adviser Bond

North Carolina's bonding rule specifies at least $35,000 for covered advisers with custody or discretion, unless the financial-rule exemption applies. That is not a bond calculated from a small capital shortfall. Confirm the financial route and any qualifying home-state exemption before applying.

What this bond does

The Investment Advisor's Bond supports the firm's Chapter 78C registration and provides for qualifying claims arising under that chapter. The rule calls for Form NCIAB or an Administrator-approved equivalent, not an unrelated financial-services bond.

Who needs it
The advisory firm satisfying a North Carolina Securities Division request. Identify the legal registrant, custody or discretionary authority, financial position and principal place of business.
Who it protects
The actual form expressly names the Secretary of State of North Carolina as obligee for persons successfully pursuing covered Chapter 78C causes of action. It permits direct action and caps the surety's aggregate liability at the stated sum; it does not guarantee investment performance.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details of North Carolina's bond and financial routes

Rule .1704 sets minimum net worth of $35,000 for custody and $10,000 for discretion without custody, unless the adviser posts a bond under .1705. Rule .1705 specifies a bond of at least $35,000 and exempts firms complying with .1704. Do not mistake the $10,000 capital threshold or a calculated deficiency for the bond requirement.

A firm principally based elsewhere can qualify for the bonding exemption when registered in its home state and compliant with that state's bonding requirements. The rule also permits an accepted cash or securities deposit instead of a bond. These are separate regulatory routes, not additional options in this page's provider checkout.

The posted undertaking continues through the license period and renewals unless canceled. It requires thirty days' written notice to the principal and Secretary, while preserving liability incurred before termination. Its action deadlines are claim provisions, not a bond term. Confirm the current accepted document, execution and filing; do not assume an automatic grace period after unexpected termination.

Questions about this bond

Can my bond just equal the financial shortfall?

Rule .1705 specifies at least $35,000; it does not state a deficiency-rounding formula. The $35,000 custody and $10,000 discretion figures in .1704 are net-worth requirements for the separate financial route. Have the Division confirm which route applies.

Does my home-state address alone establish an exemption?

The bonding exemption also requires registration as an adviser in that state and compliance with its bonding requirements. Match all conditions, not just the address. Financial-rule treatment has its own home-state capital conditions.

Where does Purchase Now take me?

It opens Propeller's North Carolina investment-adviser application in a new tab. Match the firm, Secretary of State obligation, required sum and dates after confirming the applicable route. Review and execute the issued form, then file with the Securities Division as directed. Provider payment does not complete registration.
