North Dakota — Third Party CDL Testing Bond

North Dakota's April 2026 testing-program application calls for an attached $5,000 surety bond. Match the entity applying for program approval, not just an individual examiner's name. NDDOT calls the organization a Third Party Program and its certified employee a Third Party Tester.

What this bond does

Provide the security required with the entity's NDDOT CDL third-party testing-program application.

Who needs it
The entity applying to operate an authorized CDL testing program in North Dakota. Its individual tester employees apply separately for their own testing certificates.
Who it protects
NDDOT identifies 49 CFR 383.75 as governing its oversight of the program. That provision requires State-determined security for re-testing after a tester or its examiners engage in CDL skills-testing fraud, with a government-entity tester exception. Match the program's actual status and full NDDOT-accepted undertaking.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for the program entity and tester certificates

SFN 61561, revised April 2026, asks for the entity's administrative office, years in operation, description, commercial vehicles and classes of testing. Its attachment field specifies a $5,000 surety bond. Have NDDOT confirm that sum and the full accepted condition for the actual program request.

The program application also requires locations for vehicle inspection, backing controls and the start and end points of the road test, with a map and the proposed road-test route. Have the entity's authorized official coordinate these details; the undertaking does not approve locations or routes.

SFN 61560, also revised April 2026, is the separate application for an individual Third Party Tester. It requires employment by the certified program, or employment as a condition of authorization, along with the applicant's driving qualifications, fingerprint background check and character references.

The individual application states that its applicant is not a current NDDOT employee or an instructor in a licensed or approved driver-education program. Do not assume an instructor credential substitutes for NDDOT tester eligibility or the program entity's own approval.

Obtain the actual required bond period, execution and filing instructions from NDDOT. Keep the issued undertaking with the entity's program application and maintain separate employee certificates. Confirm continuation when the Department requires it rather than assuming the April 2026 form revision establishes an annual bond term.

Questions about this bond

Does North Dakota use Third Party Tester to mean the testing company?

NDDOT calls the entity the Third Party Program and its certified employee a Third Party Tester. SFN 61561 is the entity application; SFN 61560 is the individual's application.

Does a driver-instructor credential replace the tester application?

No. The individual SFN 61560 has separate qualifications and states that its applicant is not an instructor in a licensed or approved driver-education program. Have NDDOT determine eligibility for the actual role.
