South Carolina — Preneed Funeral Contracts Bond

A South Carolina funeral home's preneed financial responsibility follows its outstanding insurance-and-trust balance. The Department of Consumer Affairs publishes four required security tiers. Prepare that balance and the actual provider's license details before applying for the performance bond.

What this bond does

Provide the preneed funeral provider's Department-accepted performance security under S.C. Code § 32-7-50(B).

Who needs it
The South Carolina funeral home selling preneed funeral contracts. The provider's Consumer Affairs preneed license and its employed funeral director's licensing are separate requirements.
Who it protects
The Department's form benefits the State and persons covered by the principal's preneed contracts. It secures the provider's Chapter 7 obligations and specified claims, losses and expenses resulting from failure, or alleged failure, to perform. Covered persons may proceed against it upon default, subject to the form and its aggregate limit.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for financial responsibility and earlier contracts

The Department's schedule uses total insurance-and-trust balance: $0–100,000 requires $15,000; $100,001–250,000 requires $30,000; $250,001–500,000 requires $45,000; and $500,001 and over requires $75,000. Match the Department's accepted balance and tier, including outstanding insurance-funded contracts rather than counting only trust accounts.

Consumer Affairs accepts a preneed performance/surety bond or an irrevocable standby letter of credit as financial responsibility. The funeral home is responsible for maintaining the appropriate sum as its outstanding contracts increase. Purchase Now here opens the bond application, not a bank letter-of-credit application.

Security does not replace the Chapter 7 trust-deposit duties or the Department's approval of preneed contract forms. Identify the provider, directly employed licensed seller and actual contracts. A funeral director's professional license does not by itself authorize the home to hold preneed payments.

The selected Department bond form permits cancellation by either principal or surety after 30 days' written notice by registered mail to the other party and Consumer Affairs. Notice to the Department is a condition of cancellation. Follow that procedure rather than treating an informal request as release.

For earlier contracts, the form preserves liability where both the promised property or services have not been received and all collected money is not on deposit in a federally insured institution in the principal's name as trustee for the beneficiary. Cancellation does not automatically erase those earlier obligations. The surety's aggregate liability for all breaches cannot exceed the stated bond sum.

Have these ready

  1. Identify the actual funeral-home provider, preneed license and employed licensed seller.
  2. Calculate the total outstanding insurance-and-trust balance for the Department's tier.

  4. Keep contract-form approval and trust-deposit duties alongside the security requirement.
  5. Coordinate actual dates, execution, registered-mail notice and earlier-contract obligations before Department filing.

Questions about this bond

Should the security calculation count only trust-funded contracts?

No. Consumer Affairs' published schedule is based on total insurance-and-trust balance. Have it confirm the combined outstanding balance and appropriate tier for the provider.

Does cancelling the bond release every earlier contract?

No. The selected form retains liability for earlier contracts under its combined outstanding-property/services and missing-trust-deposit conditions. Follow the full form and registered-mail notice requirements; do not assume cancellation settles previous defaults.
