Tacoma, WA — Right Of Way Permit Bond

Tacoma generally requires a licensed contractor's active $15,000 ROW bond on file before issuing the covered permits. This continuing permit security is different from a project-specific performance bond or the Responsible Party's groundwater-monitoring-well bond.

What this bond does

Helps a Tacoma contractor prepare continuing ROW security, original-document filing and separate project permit approvals.

Who needs it
Licensed contractors performing Tacoma ROW work and other activities covered by the city's ROW bond requirements.
Who it protects
The city form secures permit/ordinance compliance, completion of permitted work and protection of Tacoma against judgments, costs and expenses from personal injury or property damage arising from that work.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Identify the contractor's continuing ROW obligation

The city lists activities including sidewalk/driveway work, utility trenching, barricading, sign installation and Work Orders. It also addresses storm/sanitary sewer work on private property: the contractor bond requirement still applies when the permit is issued to a contractor.

A separately determined project-specific performance bond may also be required. The city's narrow single-family-owner exception for wholly private, hand-tool sewer repair is not an exception for contractor-issued permits. Confirm the actual permit and applicant role.

Prepare the city form and original filing

The currently linked ROW form names Tacoma and $15,000. Use the full legal company name consistently with insurance, state contractor licensing and the Tacoma business license. For a sole proprietor/DBA, the guide calls for the individual's and DBA's full legal names.

The city requires its original stamped/signed form, completed signatures and any required notarizations, and a Power of Attorney meeting its original/signature/seal requirements. Other forms, ordinary copies, emails, faxes and riders are not accepted as the original bond. Follow the tip sheet's mailing directions to Planning and Development Services.

Keep prior-permit liability separate from cancellation

The form is continuous and addresses permits issued over time. Its minimum ten-day cancellation notice to the Director does not release liability for earlier permits; it remains effective for their work and for at least one year after completion and acceptance of a street cut or excavation.

Use the existing Propeller application with the current city form, then file the issued original for acceptance before permit issuance. Obtain the actual work authorization and inspections. Confirm continuation and release with the city rather than treating a provider payment or one completed project as the end of coverage.

Have these ready

  1. Confirm permit type, contractor/applicant role and any separate performance or well security.
  2. Match the full legal principal across city/state licensing and insurance.
  3. Prepare Tacoma's $15,000 ROW form and required signatures, notarizations and Power of Attorney.
  4. Mail the original as directed, obtain city acceptance/permit approval and confirm continuing prior-permit obligations.

Questions about this bond

Is this the project performance bond?

No. Tacoma describes continuing ROW security and project-specific performance security separately. A Work Order can involve both.

Can I email a copy of the bond?

The city guide requires the original stamped/signed city form and specifies the Power of Attorney requirements. Ordinary copies, emails and faxes are not accepted as the original bond.

Does ten days' notice release earlier permits?

No. The form preserves earlier-permit liability, their work obligations and a minimum year after street-cut/excavation completion and acceptance.

Does the homeowner sewer exception apply to contractors?

The guide says the ROW bond requirement always applies when the sewer permit is issued to a contractor. The stated owner exception is narrowly limited to wholly private hand-tool work.
