Texas — CDL Third Party Skills Testing Provider Bond

Texas DPS requires CDL third-party skills-testing providers to show security of $25,000 for each examiner employed. Its CDL-18 model specifies $25,000 per certified examiner. Match the provider's actual examiner roster and total required sum; one $25,000 bond is not automatically sufficient for a multi-examiner business.

What this bond does

Provide the applicant company's required security for Texas DPS third-party CDL testing certification and its actual examiner staffing.

Who needs it
A qualified Texas provider seeking authorization to examine its students or employees for CDL classes A, B or C. The provider company, Designated Responsible Person and individual examiners have separate application responsibilities.
Who it protects
CDL-18 protects Texas DPS and requires prompt payment of reasonable re-testing expenses after the provider or its examiners engage in skills-testing fraud. Payment follows Department evidence reasonably demonstrating the need for re-testing; the form does not condition that trigger on first obtaining a final court judgment.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for staffing, dates and DPS release

DPS's provider instructions require a permanent occupied Texas structure, evidence of qualifying commercial vehicles, prior continuous operation and DPS certification of the basic-controls pad and test route. Have DPS confirm eligibility and the certified examiner roster before matching security. The bond does not supply those approvals.

The posted undertaking identifies DPS as obligee, the applicant business as principal and a Texas-authorized surety. It calculates security by certified examiner, with an aggregate sum and provision for amendment by rider. Have DPS and the provider confirm how staff additions or departures affect the actual required total.

The form states a definite effective period and permits continuation at the surety's option, while also requiring continuous effect until DPS gives the bond provider written authorization to discontinue. Have those provisions and the accepted dates coordinated before execution; do not assume the expiry field alone permits the testing provider to stop maintaining security.

Read the deadlines separately. Clause 2 addresses proceedings brought within one year after termination or expiry, but clause 4 requires a payment demand or request before the bond's expiry date. The later proceedings limit is not permission to postpone a payment demand beyond its separate deadline.

Continuation does not make the surety's liability cumulative from period to period. The form also says its terms prevail if inconsistent with the underlying memorandum. Match the full accepted wording with DPS, complete principal and surety execution, and submit through the Program Review Section's current instructions.

Questions about this bond

Does $25,000 cover the entire company regardless of examiner count?

No. DPS's program requires $25,000 for each examiner employed, and CDL-18 specifies the certified-examiner basis. Match the actual roster, total required sum and any staffing changes with DPS.

Can a payment demand wait until a year after the bond ends?

Do not assume that. CDL-18 has a one-year proceedings provision but separately requires payment demands or requests before expiry. Read both with the actual dates and DPS's continuous-effect/discontinuance requirement.
