Walpole, MA — Right Of Way Street Opening Bond

Walpole requires the contractor doing the public-way work to apply for its permit. Section 401 of the Town's published policy sets a $10,000 minimum bond, allows a higher amount and describes conditional use of one bond for multiple excavations.

What this bond does

Town of Walpole, Massachusetts street-opening security for the performing contractor's permitted public-way work and restoration.

Who needs it
The actual contractor working in the Town right-of-way, including affected driveway-apron work rather than only excavation in the traveled lane.
Who it protects
The published street-opening instrument concerns satisfactory permitted work and restoration of the affected way. It is not a general guarantee of the customer's entire private construction contract.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Use the performing contractor and actual work scope

Engineering says the contractor performing the work must apply because bonding and insurance requirements attach to that applicant. The public way includes shoulders, curbs, sidewalks and the driveway apron between private property and the traveled way. Work on that apron may need a permit even when the rest of the driveway is private.

Section 401 requires an accepted bond before permit issuance, with a $10,000 minimum that the Town Engineer may increase. The Engineer may accept one bond for multiple excavations if the work value is adequately secured; do not assume unlimited openings are covered by one minimum bond. A bank-passbook alternative requires the separate Town process described in the policy.

Keep the full repair period separate from the work season

The policy requires bond coverage for one full year from completion of the work and says the Town will not accept cancellation notices before that responsibility period expires. Confirm the accepted instrument's dates and continuing coverage with the Town and issuer; this is not a displayed one-year term starting at checkout.

Purchase Now opens Propeller. The option displays no fixed amount or term. Match the Town's form, contractor/recipient, assigned sum and coverage with the issuer, arrange execution and accepted Engineering filing, and obtain the signed permit.

Engineering's current routine-season notice says November 15 closure and April 1 reopening, weather permitting. Use that current notice and the actual permit when scheduling, rather than assuming the policy's outer seasonal dates guarantee issuance. Coordinate any required utility-location approval, separate trench permission and inspections; finishing the season does not end the completion-based bond responsibility.

Questions about this bond

Can the owner apply instead of the paving contractor?

Engineering says the entity applying must be the contractor performing the work because the bond and insurance requirements apply to that entity.

Can one minimum bond cover unlimited openings?

No. The Engineer may accept one bond for multiple excavations subject to the value secured and may require an increase. Obtain approval for the actual outstanding work.

Does coverage end when routine street-opening permits close?

The policy requires one full year of coverage from work completion. The seasonal issuance window and the bond responsibility period are different.
