Wisconsin — Commercial Driver License (CDL) Third Party Tester Bond

Wisconsin requires non-government CDL third-party testers to maintain a bond in an amount set by WisDOT's schedule. Match the testing company and its current authorization request. Its employed examiners need separate certificates; an examiner application is not the company's bond filing.

What this bond does

Maintain the non-government testing company's required security under Trans 115.09(4) and its WisDOT testing agreement.

Who needs it
The applicant or authorized CDL third-party testing company, rather than a driver booking a skills test. WisDOT's current instructions ask prospective companies and examiners to contact its CDL unit before applying.
Who it protects
Trans 115.09(4) requires sufficient security to pay for driver re-testing when the tester or its examiners engage in fraudulent CDL skills-testing activity. The provision excludes State agencies or departments, political subdivisions and another State. Confirm the actual entity's status and the full accepted undertaking.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for the company agreement and annual renewal

The company needs a Wisconsin primary business location, a responsible safety officer and at least one employed examiner. Its testing locations and road routes require WisDOT approval. Coordinate the organization application and each examiner's separate application with the CDL unit.

Trans 115.09(4) leaves the required sum to a Department-determined schedule rather than printing one fixed amount for all companies. Obtain the current schedule amount and accepted bond wording for the actual applicant. Do not use a company's insurance limits as its bond amount.

The current MV3549 document is the testing-company agreement. It requires maintenance of insurance and security under Trans 115.09, annual proof, and compliance with the applicable testing laws. Have WisDOT supply the actual accepted undertaking with the application instructions.

Company and examiner authorizations renew annually. Trans 115.06 generally ends certificates at calendar-year end, with a next-calendar-year exception for those first issued after June 30, and requires renewal submissions at least 30 days before expiry. Coordinate security and required proof with the actual authorization rather than assuming every new certificate lasts exactly twelve months.

The agreement's termination language and the insurance provisions have their own purposes. Neither the insurance/self-insurance thirty-day notice language nor termination of the company agreement establishes a bond cancellation right. Read the issued undertaking's actual dates, continuation and notice requirements before filing.

Questions about this bond

Does Wisconsin's rule print one fixed bond amount for every testing company?

No. Trans 115.09(4) uses a schedule determined by WisDOT. Obtain the amount for the actual applicant and do not substitute the insurance limits.

Does a new authorization always run for exactly twelve months?

No. Trans 115.06 generally expires it at calendar-year end, with an exception for authorizations first issued after June 30. Match actual expiry and renewal submissions; those certificate rules do not set the bond's own cancellation terms.
