California — Cannabis Testing Laboratory Bond

California cannabis testing laboratories use the Type 8 license. Match the laboratory's legal applicant, licensed premises and DCC bond request before completing the provider application. DCC's bond instructions call for at least $5,000 for each licensed premises; the bond does not establish laboratory accreditation or approve test results.

What this bond does

Provide the State's required commercial cannabis license security for the testing laboratory, addressing violation-related destruction costs and the compliance obligations in DCC's accepted undertaking.

Who needs it
Type 8 laboratory applicants and licensees testing cannabis goods before retail sale. Coordinate the actual laboratory license, premises and accreditation or authorized interim-license process.
Who it protects
DCC Form 8113 names the State of California as obligee. Its condition addresses required destruction of cannabis or cannabis products following violations, MAUCRSA compliance and money due to the State under the undertaking. It is not a separate guarantee of a client's test results or refund.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for a Type 8 laboratory

DCC states that Type 8 testing laboratories must obtain and maintain ISO/IEC 17025 accreditation and can use an interim testing license while working on accreditation. Match the laboratory's actual status and permitted work. Issuing a bond does not replace accreditation, an interim license or the Department's laboratory requirements.

The bond instructions require at least $5,000 for each licensed premises and an authorized California corporate surety. DCC permits aggregation for multiple licenses held by the same business, but that does not mean one $5,000 amount automatically covers every location. Match the actual applicant, laboratory premises and complete license schedule.

The accepted form uses the State's commercial cannabis condition, including violation-related destruction and compliance duties. It continues through the license and renewals from receipt of the license, subject to its cancellation provisions. The form requires 30 days' written cancellation notice delivered to DCC and the principal, with earlier covered liability preserved; the aggregate limit does not restart annually.

Use the legal name, trade or fictitious names and service addresses required by the form. DCC's instructions call for Form 27 and a copy of the changed or new bond with Form 8113 when changes are submitted. Confirm the actual Department filing and execution requirements rather than treating a provider confirmation as approval to test.

Sources

Have these ready

  1. Identify the Type 8 laboratory applicant, license numbers, legal and trade names and each licensed premises.
  2. Confirm the actual accreditation or interim testing-license status without treating the bond as technical approval.
  3. Obtain DCC's current accepted undertaking, required sum and complete covered-license schedule.
  4. Match license receipt, renewal continuity, aggregate coverage, cancellation provisions and signing authority.
  5. Submit the required bond evidence and any Form 27 change materials through DCC's instructions.

Questions about this bond

Does buying the bond establish ISO/IEC 17025 accreditation?

No. DCC requires testing laboratories to obtain and maintain that accreditation and describes an interim testing license while accreditation is being pursued. Match your actual authorized status; a bond does not approve testing work or results.

Can one $5,000 bond automatically cover every laboratory site?

Do not assume that. DCC calls for at least $5,000 for each licensed premises and permits aggregation for multiple licenses held by the same business. Have the actual sites, license schedule and required aggregate coverage matched before filing.
