California — Commercial Fundraiser For Charitable Purposes Bond

California requires commercial fundraisers to register before soliciting and provide $25,000 security with registration and renewal. CT-4CF is the Registry's surety undertaking. Keep that continuing security separate from annual registration, campaign notices and financial reports; one purchase does not file all four.

What this bond does

Provide accepted commercial fundraiser security under Government Code Section 12599.5 for filing with the Attorney General's Registry of Charities and Fundraisers.

Who needs it
The compensated commercial fundraiser soliciting money or property for a charity, including qualifying mail, telephone, internet, event, vehicle-donation or thrift operations. Identify the actual fundraiser rather than using the beneficiary charity as the principal.
Who it protects
CT-4CF is bound to California and requires the principal's statutory compliance, payment of covered sums received and damages from unlawful acts or omissions of the principal or its agents/employees within their employment. Its instructions identify protection for persons damaged by covered fundraising malfeasance or misfeasance. The surety's aggregate for all claims cannot exceed $25,000.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for CT-4CF and the separate Registry filings

Match the principal's legal and business names and service address to the commercial fundraiser's record. CT-4CF identifies an admitted surety, its service address and the $25,000 condition. The actual surety execution is under an unrevoked Power of Attorney with its attorney-in-fact's dated declaration under California perjury law.

The model is continuous and preserves liabilities for acts, omissions and causes arising before cancellation or withdrawal. Cancellation is governed by the cited California Code of Civil Procedure provisions; obtain the accepted undertaking's actual notice and withdrawal instructions instead of assuming another state's fixed notice period.

Registration uses CT-1CF, is reviewed by the Registry and is effective for the remainder of the calendar year once granted. Renewal is annual, with required security evidence. The current Online Filing Service accepts registration and supporting security documents; use the current Registry directions rather than assuming the provider delivers and files them automatically.

File CT-10CF before each covered campaign. The Registry specifies at least ten working days' notice, with a start-of-solicitation exception for emergency-hardship or disaster campaigns. Annual financial reports are due January 30, using the appropriate standard, thrift-store or vehicle-donation form for the activity.

Maintain the required written charity contract, control over solicitation content and proper handling of contributions. The Registry says a contract copy is not routinely submitted unless requested; this does not remove the duty to have a compliant contract. Registration is not an endorsement of the fundraiser, charity or campaign.

Sources

Have these ready

  1. Identify the actual commercial fundraiser, legal/business names and service address.
  2. Arrange the accepted $25,000 CT-4CF condition and admitted surety.
  3. Confirm the surety attorney-in-fact's authority, declaration, dated execution and actual cancellation instructions.
  4. Prepare CT-1CF registration/renewal with supporting security through the current Registry route.
  5. Track CT-10CF campaign notice, January 30 financial reporting and the separate written charity contract.

Questions about this bond

Does filing CT-4CF also submit my campaign notice?

No. CT-4CF supplies surety security. CT-10CF is a separate notice for a covered campaign, generally at least ten working days before it begins, with the Registry's stated emergency-hardship/disaster exception.

Must I routinely file the charity contract with the Registry?

The Registry says a copy is not required unless specifically requested. You still need the compliant written contract and must meet its statutory requirements; the bond does not replace that agreement or its controls.
