California — Process Server Bond
California requires $2,000 security with a process-server registration when Chapter 16’s registration rules apply. The Southern Agency’s listing is the surety route. Start with the correct individual, corporation or partnership and filing county—not the assumption that everyone who delivers legal papers needs the same registration.

What this bond does
The bond is conditioned on compliance with the process-server chapter and California laws governing service of process. It accompanies the county-clerk registration, and the clerk sends it to the county recorder for recording.
- Who needs it
- For an individual, §22350 applies to more than ten services within a calendar year for specific compensation or expected compensation directly attributable to service. A corporation or partnership deriving or expecting such compensation has its own registration requirement. Statutory exemptions include specified government/court, attorney, investigator and limited photocopier situations; check the actual capacity.
- Who it protects
- Under §22357, a person recovering damages in an action/proceeding for injury from a registrant’s unlawful service may recover those damages from the bond. Total aggregate liability is $2,000, not $2,000 for each document served. It does not guarantee a case outcome or establish that every attempted service is valid.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Questions about this bond
Is the individual threshold ten or more paid services?
The current statute says more than ten in a calendar year, with the specified compensation connection. Corporations/partnerships have a separate compensated-business rule, and exemptions must be considered. Do not apply the individual threshold indiscriminately to every applicant.
Does company registration automatically cover each server’s individual filing?
Do not assume so. Individual and entity requirements are distinct. Los Angeles County expressly requires officers/partners serving process to file/post the individual bond and says employees are not covered by the entity registration; follow the actual filing county’s current instructions.
Will registration always last two years after I buy?
Section 22354 limits it to two years or earlier bond expiry. Purchase alone does not establish registration or the clerk’s accepted start date. Match the actual instrument dates and complete county filing/recording.
