Georgia — Paid Solicitor Bond

A Georgia paid solicitor with physical possession or legal control of collected contributions must provide $10,000 security. Match S-100D to the actual business and its start date through December 31. Registration, the charity contract and campaign filings still need separate attention after the bond is arranged.

What this bond does

Provide Secretary of State-accepted paid solicitor security under O.C.G.A. Section 43-17-4 for the contribution-handling role described in the registration.

Who needs it
The compensated paid solicitor handling collected contributions through physical possession or legal control. Georgia's guidance also includes fundraising counsel that has custody of contributions in the paid solicitor definition. Do not assume the benefiting charity is the bond applicant.
Who it protects
S-100D runs to Georgia's Secretary of State for the state and persons with causes of action for solicitation malfeasance or misfeasance. It conditions security on faithful, honest and lawful conduct, compliance with the Charitable Solicitations Act and indemnification of covered loss. Recoveries may continue until the single $10,000 aggregate is exhausted.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for contribution control and the December 31 term

Answer S-100's physical-possession/legal-control question from the actual collection arrangement. If it applies, the application requires the $10,000 Secretary of State-satisfactory undertaking and the required financial statement. The broader duty to register as a paid solicitor is not itself proof that every applicant has this contribution-handling role.

Use the business's legal name as S-100D principal, with the accepted surety and actual term beginning date. The form ends December 31 of the entered year; registration also expires December 31. Plan the annual renewal and applicable current security instead of assuming a year measured from checkout.

Complete principal and surety signatures/titles, seals and the form's official-witness execution. The Secretary's current guide expressly directs notarization of the bond form. The separate S-100 application has its own executive-officer execution, notarization and supporting disclosure requirements.

The Secretary currently encourages online filing and also publishes a mail route. Prepare the registration/renewal application and attachments through that current route; the state reviews them and may request more information. Payment to the provider is not the state's receipt or registration approval.

Before each campaign, file S-200 with the charity contract and compensation terms. File S-300 accounting with both the charity and Secretary within ninety days after completion and on the anniversary of a campaign longer than a year. Keep material registration information current through required amendments; filing the bond alone does not maintain those records.

Sources

Have these ready

  1. Describe physical possession or legal control of contributions and identify the actual paid solicitor.
  2. Match the principal to S-100, the charity contract and the accepted $10,000 S-100D condition.
  3. Arrange the actual start date through December 31 and applicable renewal security.
  4. Prepare the required signatures, seals, notarization, application disclosures and financial statement.
  5. Plan S-200 precampaign filing, S-300 accounting and material-change amendments through the current Secretary of State route.

Questions about this bond

Does the security requirement depend only on whether I physically receive money?

No. Georgia's current instructions also include legal control of collected contributions. S-100 asks about physical possession or legal control and requires security and a financial statement when that answer applies.

Does a late-year bond purchase give me twelve months of registration?

No. The S-100D term ends December 31 of the entered year, and paid solicitor registration expires December 31. Prepare the actual year's document and the required annual renewal rather than measuring from purchase.
