Nevada — Cemetery Seller Bond

Nevada's Cemetery Seller Bond Template belongs to the cemetery authority's prepaid-sales permit. For trust-funded cemetery merchandise and services, the Division requires at least $50,000 or the sum it determines. Prepare the seller entity and funding arrangement while keeping its endowment-care responsibilities separate.

What this bond does

Supply the cemetery seller's accepted prepaid-contract security under NRS 689.495.

Who needs it
The cemetery-authority entity licensed by the Nevada State Funeral Board and applying for or maintaining cemetery-seller authority. Employees selling on its behalf need their own cemetery-agent licenses.
Who it protects
The actual cemetery-seller form protects persons damaged by covered violations of Nevada insurance law and is payable to the State. It requires faithful compliance by the principal, its agents and employees, and payment of covered damages from violations or fraud, dishonesty, misrepresentation or concealment of material facts in governed transactions.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for the prepaid permit and endowment care

Use the Cemetery Seller Bond Template selected by the Division for the trust-funded prepaid permit. The published security is no less than $50,000 or the Commissioner's determined sum. An accepted cash or negotiable-securities deposit is an alternative maintained at the required market value; this page opens the bond application rather than arranging that deposit.

A cemetery seller sells the cemetery authority's burial merchandise and services. Its permit does not authorize prepaid funeral-home or mortuary sales, which belong to the separate funeral-seller program. Name the actual cemetery entity on the undertaking and coordinate the employee cemetery-agent licenses.

The Division separately describes endowment-care funds and annual financial reporting for cemetery authorities unless exempt. Maintain those obligations alongside the prepaid-sales permit. The seller bond is not a replacement endowment-care fund, and its stated sum does not establish how much must be entrusted for cemetery upkeep.

The published bond exception requires both that the seller offer only contracts payable solely from life-insurance proceeds and that it collect no money from the purchaser. Confirm the actual arrangement rather than assuming any insurance-funded sale removes security. A life policy remains a separate contract requiring a licensed producer.

The Division asks for a mailed, tabbed and referenced application packet and approval of prepaid contract forms before use. Its actual bond continues until Commissioner release or surety cancellation under the form and Nevada law, with written notice to the principal and Commissioner. Coordinate effective date, principal execution, surety seal and attorney-in-fact execution; the triennial license cycle does not set the bond period.

Questions about this bond

Does the seller bond replace the endowment-care fund?

No. The Division describes endowment-care funding and reporting separately for nonexempt cemetery authorities. Match those obligations as well as the prepaid-sales permit; the seller bond's sum is not the cemetery's required care-fund balance.

Can the cemetery-seller permit be used for prepaid funeral-home services?

No. The Division separates cemetery-authority merchandise and services from the funeral-home/mortuary program. Identify the actual seller and activity before matching the undertaking.
