New Mexico — Professional Fundraiser Bond
New Mexico requires professional fundraiser registration before contracting to solicit for a charity that must register. Its current application includes a $25,000 bond. Taking donor pledges can count even when money goes directly to the charity, so establish the real solicitation role before treating the business as advice-only counsel.

What this bond does
Supply the professional fundraiser security required with New Mexico's registration application under the Charitable Solicitations Act.
- Who needs it
- The paid professional fundraiser applicant, not the charity receiving donations. NMDOJ distinguishes soliciting and controlling contributions from counsel that neither directly solicits nor receives, accesses or controls contributions.
- Who it protects
- The actual undertaking runs to New Mexico for the Attorney General and persons with causes of action under the Act. It conditions the obligation on faithful compliance with applicable state laws and the Registrar's rules; a covered violation makes the obligation payable up to its stated sum. It does not guarantee fundraising results or replace the charity's own registration.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Questions about this bond
Am I advice-only counsel because the charity receives the checks?
Not necessarily. NMDOJ says taking pledges can make the activity professional fundraising even when the eventual money is sent elsewhere. Describe direct solicitation and access/control, not only the bank account receiving cash.
Does the model run indefinitely?
No. The posted bond expires one year after its effective date. The current application directs prompt delivery of replacement security when the bond expires. Do not confuse that bond term with an assumption about when the registration itself must be refiled.
