What this bond does

New York Executive Law § 173 requires a professional fund raiser to file a $10,000 bond for the attorney general’s approval with each application for registration or re-registration. Registration is required before acting on behalf of a charitable organization subject to Article 7-A.

Who needs it
The professional fund raiser named in the registration application. Fund raising counsel, professional solicitors and charities have their own roles and forms; a charity should not purchase this simply because it raises money.
Who it protects
The bond runs to the attorney general for the state and people with a cause of action for solicitation malfeasance or misfeasance. CHAR015 requires faithful, honest, lawful conduct, Article 7-A compliance and indemnification of covered loss. Successive recoveries share the $10,000 sum; it is not insurance for a charity's entire fundraising campaign.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Match CHAR015 to the registration statement

The attorney general publishes CHAR013 for professional fund raiser registration and CHAR015 for the annual bond. CHAR015 says the principal’s name must match Part A1 of CHAR013 exactly. Use the registered legal name rather than a campaign name or a client charity’s name.

CHAR015 identifies the bond’s beginning date with the start of the annual registration and describes a period ending exactly one year later. Coordinate the dates with the registration being filed instead of assuming a calendar-year term.

Prepare the executed bond for filing

CHAR015 requires certification by an authorized representative of the principal and the surety’s attorney-in-fact. Its instructions call for original signatures, each signer’s printed name, title and date, and an original power of attorney for the surety’s attorney-in-fact.

Keep the executed CHAR015 with CHAR013 and its required attachments. The current linked CHAR013 instructions direct mailing the registration package to the Charities Bureau at the Capitol in Albany. Include required contracts, entity documents and any delinquent CHAR037 statements; provider checkout does not submit those records, approve registration or replace the separate contract filings.

Plan the next registration and bond together

Section 173 describes one-year registration and filing a bond with each additional registration period. Keep the registration expiration date with your bond records so the next filing can be prepared before you continue fundraising after expiration.

Select Purchase Now to begin. The $10,000 is security, not the price of the bond or the state’s registration fee. Review the premium and application conditions separately.

Questions about this bond

Does a charity buy this bond for its volunteers?

This bond names the professional fund raiser registering under Article 7-A. Do not substitute a charity or volunteer group for that principal simply because it solicits donations.

What amount does New York require?

Executive Law § 173 and CHAR015 specify $10,000. The premium is quoted separately, and registration fees are a different expense.

Do the registration and bond dates need to align?

CHAR015 ties the beginning date to the annual registration and describes a period ending one year later. Prepare it for the registration or re-registration you are filing.

Does CHAR015 need both signatures?

Yes. Its instructions require original signatures from an authorized principal representative and the surety’s attorney-in-fact, with the original power of attorney attached.
