What this bond does
Provide professional fundraiser security for Department of Business Regulation approval under R.I. General Laws Section 5-53.1-8.
- Who needs it
- The professional fundraising business with access or the ability to access or control solicited funds. Fundraising counsel also registers, but the statute's bond clause specifically describes the professional fundraiser with that access. The benefiting charity has its own registration duties.
- Who it protects
- Section 5-53.1-8 runs the security to the Director for the state and persons with causes of action for solicitation malfeasance or misfeasance. DBR's posted model names the General Treasurer, with a $10,000 aggregate for losses from malfeasance, nonfeasance or misfeasance in solicitation. Use the complete undertaking DBR accepts rather than changing its named recipient yourself.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Questions about this bond
Is the test limited to funds I physically hold?
No. Section 5-53.1-8 includes access, the ability to access, or control of funds being solicited. Explain the actual arrangement instead of relying solely on who initially receives the payment.
Should I file re-registration several months before June 30?
The statute says re-registration applications are filed no more than thirty days before the existing registration expires. Prepare ahead, but use the actual filing window and maintain the accepted security.
