South Dakota — Paid Solicitor (No Collection Of Contributions) Bond

South Dakota's $10,000 paid solicitor requirement is for solicitation without collecting contributions or otherwise having physical access to them. The no-collection label alone is not enough if your arrangement still gives access. Describe the entire donation-handling process before choosing this condition.

What this bond does

Provide the no-collection/no-physical-access paid solicitor security for Attorney General approval under SDCL 37-30-5.

Who needs it
The paid solicitor that only solicits and will neither collect contributions nor otherwise have physical access. A solicitor collecting or physically accessing contributions falls under the separate $20,000 requirement.
Who it protects
SDCL 37-30-5 protects South Dakota and persons with causes of action for liabilities from paid-solicitor activities or Chapter 37-30 violations. The posted $10,000 model binds the principal and surety for reimbursement of the state and citizens for covered claims involving the principal or its agents. It does not promise the charity a fundraising result.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for no collection and no physical access

Check every way contributions are received, held and passed on. Not collecting contributions does not answer whether you or your agents can physically access them. A charity-named bank account with sole or joint control is a separate handling requirement, not proof that the paid solicitor has no access.

Use the $10,000 prescribed condition only for the no-collection/no-access arrangement. The statute requires the applicant as principal and security maintained while registration is effective. Additional campaigns during the same registration do not themselves require additional security, but a change to collection or access must be addressed before relying on this classification.

The posted packet's $10,000 model has actual beginning/end-date fields and thirty days' prior written notification to the Office of Consumer Protection for surety rescission. Prepare the principal and surety identities, bond number, dated signatures, applicable principal acknowledgment, surety acknowledgment and attached attorney-in-fact authority.

The packet includes older execution instructions and a resident-agent countersignature field. Ask Consumer Protection for its current signing directions, including any applicable countersignature requirement. Match the person signing for the principal to the acknowledgment and the surety signer to the attached authority.

Registration and campaign paperwork remain necessary even without access to donations. Allow the statutory advance application and review period, obtain approval before soliciting, and prepare the charity contract, solicitation notice, charity consent and scripts/materials. The end of a review window or provider payment is not approval.

  5. Arrange registration approval and required campaign/charity materials before solicitation.

Questions about this bond

Is no collection enough if my staff can still access donations?

No. The $10,000 condition applies when the solicitor only solicits and does not collect or otherwise have physical access. Actual access can place the arrangement under the separate $20,000 requirement.

Does each additional campaign automatically require another bond?

SDCL 37-30-5 says additional campaigns during the registration period do not require additional security. Continue maintaining the accepted undertaking and complete each campaign's required filings.
