Washington — Commercial Fundraiser Bond

Washington's commercial fundraiser bond is not limited to businesses holding donations. The statute also reaches specified compensation arrangements, expenses incurred for a charity and applicants without registration in the preceding accounting year. Match the actual role to the $25,000 undertaking before filing.

What this bond does

Provide the commercial fundraiser security prescribed by the Secretary of State under RCW 19.09.191 and Chapter 19.09.

Who needs it
The commercial fundraiser soliciting for a charitable organization that meets a statutory bond trigger. Use the fundraiser's legal principal and business name, not the beneficiary charity's name.
Who it protects
The prescribed model benefits Washington and persons or entities with causes of action for solicitation malfeasance or misfeasance by the principal and its members, officers, employees, subsidiaries and subcontractors. It conditions discharge on performance of Chapter 19.09 and its regulations. The statute also identifies deceptive solicitation practices; all claims share one $25,000 aggregate under the model.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details for the four triggers and continuing security

RCW 19.09.191 requires security if the commercial fundraiser directly or indirectly receives public contributions for a charity; is compensated by funds raised, solicitation counts or a similar method; incurs or is authorized to incur charity expenses; or was not registered for the preceding accounting year. Do not treat direct payment to the charity as an automatic exemption from every trigger.

The June 2025 prescribed model identifies the principal, any different business name, Washington-licensed surety, surety address, bond number and registration commencement. It calls for a principal officer's signature and printed name/title and the surety officer's signature and printed name/title. Have the named officers complete the document and confirm any additional signing directions with the Secretary before filing.

The model is one continuing obligation, not a fresh $25,000 limit for every claimant. It requires notice to the Secretary at least forty-five days before surety cancellation. Keep cancellation, claims and replacement-security questions with the complete undertaking and the Secretary's directions; annual registration renewal is a different obligation.

The Secretary's current programme directs commercial fundraisers to print and mail the completed registration/renewal form and required materials. It identifies missing proof of $25,000 security as a return reason for initial filings or re-registrations. Prepare the actual application dates and required evidence rather than relying on a reminder letter as renewal.

Before fundraising starts, the charity must submit the signed fundraising-service contract registration, written agreement and required filing to the Charities Program. The fundraiser also has solicitation-disclosure and compliance duties. Arranging the security does not file that contract or authorize the activity.

Questions about this bond

Can I assume no bond is needed when donations go straight to the charity?

No. The statute has separate triggers for compensation, charity expenses and lack of registration in the preceding accounting year. Describe the entire arrangement, not just the recipient of the donation.

Does registration renewal create another $25,000 limit for every claim?

The prescribed model is one continuing obligation with a single aggregate for all claims. Registration renewal and the required security evidence should be handled separately from that liability condition.
