Minnesota — Collection Agency Bond

Minnesota's general collection agency option needs the form for the actual business organization. Commerce publishes different bonds for corporations or LLCs, individual proprietorships and partnerships. Confirm the legal principal and required amount before ordering; agency licensing and individual collector registration are separate steps.

What this bond does

The published bonds secure compliance with sections 332.31 through 332.45 and other legal obligations arising from the principal's conduct as a collection agency. Their protection is broader than a promise to remit client money.

Who needs it
Applicants for a Minnesota collection agency license, including debt buyers required to hold that license. Use the firm's legal organization and office covered by the bond, rather than an individual employee's collector-registration details.
Who it protects
The forms run to the Minnesota Department of Commerce for the State and all people damaged by a breach of the specified statutes or other agency-related legal obligations. They bind principal and surety jointly and severally. The Commissioner and a damaged person have an action on the bond, subject to its aggregate limit.

Your bond option

This is the option on record for this bond.

The bond amount describes the limit of the bond obligation, not the price. A listed amount does not establish what the requesting party requires. The premium is what you pay and must be confirmed for the actual option. An E&O limit, where listed, is separate errors and omissions insurance.

Details

Commerce requires at least $50,000, plus $5,000 for each $100,000 received from Minnesota debtors during the preceding calendar year, less commissions earned on those collections, capped at $100,000. Use the official worksheet and the Department-required amount. Do not substitute total nationwide business or assume the initial amount remains sufficient at renewal.

Select the entity form before executing the bond. The individual-proprietorship form requires the owner's signature and acknowledgment; the partnership form uses the general partner. Each also requires the surety attorney-in-fact's signature, acknowledgment and attached power of attorney. A corporation or LLC uses the Department's separate form.

The forms describe one continuing obligation, with aggregate liability that does not increase with the number of claims or years in force. The surety's cancellation becomes effective 30 days after notice is sent to the obligee, without erasing prior liability. The surety must notify the Commissioner before paying a claim.

The Department directs agency applications through Sircon. Obtain the original executed entity-appropriate bond and upload it to the online application. Complete the required financial statement, organization and assumed-name documentation, and other application questions. An individual debt collector's registration must be submitted by the licensed agency; it does not replace the agency application.

Purchase Now opens Propeller's Minnesota collection agency application in a new tab. Have the legal organization, office, required sum and Commerce request ready. Confirm which Department form the provider will issue under this general option, complete its execution and upload the accepted document through Sircon. The agency license expires June 30 and requires its own renewal; checkout does not approve or renew it.

Questions about this bond

Does this general option mean every agency uses one form?

No. Commerce publishes separate corporation/LLC, individual-proprietorship and partnership bonds. Confirm the legal applicant and the form the provider will issue under this option before executing it.

Does an employee's collector registration replace the agency license?

No. Commerce requires a qualifying agency bond and an approved agency application. The licensed agency separately submits its individual collectors' registrations.

Does the bond limit reset each licensing year?

The forms describe a continuing aggregate limit regardless of years in force or claims made. The amount still needs review against the prior year's Minnesota collections and earned commissions, with the statutory $100,000 ceiling.
